ㅇ To establish the administrative disposition standards reflecting the amended details of the Motor Vehicle Management Act
- Where a motor vehicle maintenance business operator tampers with the results of machinery or apparatus for the motor vehicle inspection
Business suspension for 30 days (cancellation of designation for the second time)
(1) Reasons for Proposal
The Motor Vehicle Management Act has been partially amended to prescribe that a person who tampers with the results of machinery or apparatus for the motor vehicle inspection shall be punished; and a motor vehicle maintenance business operator may carry out a repair at a place other than its place of business in case of emergency for a car that is pulled over for a defect (Act No. 15321, promulgated on December 26, 2017 and to be enacted on June 27, 2018).
Accordingly, this Amendment prescribes matters delegated by the Act, including the detailed standards for disposition concerning the cancellation of designation and business suspension.
(2) Major Provisions
A. Revise the wording of the provisions concerning the grounds for administrative dispositions (Article 1)
As Article 45-3 (3) of the Motor Vehicle Management Act was amended to Article 45-3 (4) due to a newly inserted Article 45-3 (3), the provisions of Article 1 of the proposal shall be revised.
B. Set the standards for administrative dispositions against tampering with the results of a machine or apparatus for the motor vehicle inspection; and reflect the amended details of the Act (attached Table)
Where a person tampers with the results of machinery or appratus for the motor vehicle inspection, he/she shall be subject to 30 days of business suspension; if the same violation is committed repeatedly, the designation shall be canceled; and the revised clauses and provisions due to the amendment of the applicable Act shall be reflected.
