(1) Reasons for Proposal

The Amendment aims to improve upon lift axle installation requirements to prevent major traffic accidents caused by the overloading of trucks, etc. To reduce casualties in motor vehicle collisions, the Amendment introduces requirements for partial head-on impact and pole side impact while aligning with international standards for such provisions as reflective tape installation requirements for trucks to prevent night time collisions, and brake system requirements for two-wheeled motor vehicles, thereby aiming to close the loopholes of the current system.

(2) Major Provisions

A. Relax ground clearance requirements and diversify the materials, etc. of storage compartment/window glass (Article 4, Article 5, Article 32, Article 34, Article 37, attached Table 33)

Improve upon the design and performance of motor vehicles by relaxing ground clearance requirements to match speed bump requirements for domestic roads; diversifying materials used for storage compartments; and improving requirements for the opening direction of exhaust pipes.

B. Improve lift axle installation requirements and introduce reflective tape installation requirements (Article 13, Article 49, attached Table 32-2)

Prevent major traffic accidents caused by the overloading of trucks, etc., by prescribing that the lift axle shall detect the load on the axle and be automatically raised; and prevent nighttime collisions of trucks by introducing reflective tape installation requirements that match international standards.

C. Modifying requirements for engine output error and braking systems for two-wheeled motor vehicles (Article 63-2, Article 67, attached Table 5-13)

Clearly distinguish between internal combustion engines and drive motors as for engines of two-wheeled motor vehicles and modify the respective output error bounds in accordance with the self-authentication system.

Ensure safety and align combined braking systems with international standards by prescribing compulsory installation of anti-lock braking systems (ABS) for two-wheeled motor vehicles.

D. Align impact requirements with international standards (Articles 89, 91, 92, and 102; attached Tables 11-3, 11-5, 14, and 14-2)

Reduce damage caused by motor vehicle collisions and address commercial issues arising from the trading of motor vehicles by introducing the requirements for partial head-on impact and pole side impact and otherwise aligning motor vehicle impact requirements with international standards.

(3) Amendment Details

Partial Amendment to the Rules on Motor Vehicle and Automotive Parts Performance and Requirements

Partially amend the Rules on Motor Vehicle and Automotive Parts Performance and Requirements as follows.
In Article 4, paragraph 2 excluding the subparagraphs, change “eachsubparagraph” to “each subparagraph,” and newly insert a proviso to the same paragraph excluding the subparagraphs as follows.
  Provided, that items specified by the Minister of Land, Infrastructure and Transport, such as devices for fixating the loads, shall be excluded from the scope of measurement.
In the main sentence of Article 5, change “12 centimeters” to “10 centimeters.”
In the main sentence of Article 13, paragraph 7 excluding the subparagraphs, change “a lifting mechanism and pressure controller shall be installed on the lift axle on the left-hand side of the motor vehicle, or near the rearmost axle” to “the lift axle shall have a structure in which it is automatically lowered and cannot be raised when the adjacent axis is under a live load that exceeds the axle load specified in Article 6 or exceeds the allowable axle load prescribed in the specification,” and change the proviso to the same paragraph excluding the subparagraphs as follows.
  Provided, that a manual override that meets the requirements in the following subparagraphs may be installed for escaping from rough roads, etc.
Change Article 13, paragraph 7, subparagraphs 1 and 2 as follows.
  1. Shall not exceed 130 percent of the design allowable load of each drive axle;
  2. Shall have a structure in which the front axles are not lifted off the ground under operation;
In Article 13, paragraph 7, newly insert subparagraph 3 as follows.
  3. Shall have a structure in which the axle is automatically lowered to support the load before the motor vehicle reaches a speed of 30 kilometers per hour after leaving the rough road.
In the main sentence of Article 32, paragraph 1, subparagraph 2, item C, change “the same materials” to “materials of equivalent performance.”
In the main sentence of Article 34, paragraph 1, change “insulated glass” to “insulated glass, plastic glass.”
Change Article 37, paragraph 1 as follows, and delete paragraph 2 in the same Article.
 ① The opening direction of the exhaust pipe of a motor vehicle shall not exceed 45 degrees to the left or right from the lengthwise direction of the motor vehicle, and the tip of the exhaust pipe shall not protrude outside the motor vehicle body.
Newly insert Article 49, paragraph 8 as follows.
 ⑧ Any truck or special purpose vehicle (excluding incomplete motor vehicles and tow vehicles) with a gross vehicle weight exceeding 7.5 tons, and any towed motor vehicle (excluding incomplete motor vehicles) with a gross vehicle weight exceeding 3.5 tons, shall be fitted with reflective tapes that meet the following requirements on its sides (only where the length of the motor vehicle exceeds 6.0 meters) and rear (only where the width of the motor vehicle exceeds 2.1 meters); Provided, that reflective tapes may be affixed to any motor vehicle excluding passenger vehicles and towed motor vehicles with a gross vehicle weight of not more than 0.75 tons. In this case, the reflective tapes shall meet the following requirements.
  1. The light reflected by reflective tapes shall be of a color that meets the following requirements:
    A. Front: White
    B. Sides: Yellow or white
    C. Rear: Yellow or red
  2. Requirements for the installation and reflective performance of reflective tapes shall be in accordance with the attached Table 32-2.
Change Article 63-2 as follows.
Article 63-2 (Engine Output Error, etc.) Errors concerning the engine output and RPM of two-wheeled motor vehicles shall be within the following limits:
  1. Internal combustion engine
    A. Maximum output and maximum torque
      1) Where maximum output is not more than 11 kilowatts: ±10 percent
      2) Where maximum output is more than 11 kW: ±5 percent
    B. RPM: ±1.5 percent of the RPM
  2. Drive motor
    A. Maximum output
      1) Where maximum output is not more than 11 kilowatts: - 10 percent
      2) Where maximum output is more than 11 kW: - 5 percent
    B. Other partial output (excluding drive motors with a maximum output of not more than 11 kilowatts and the highest 30-minute output): - 5 percent of the output
    C. RPM: - 5 percent of the RPM
    D. Highest 30-minute output: - 10 percent
Change the main sentence of Article 67, paragraph 1, subparagraph 4 excluding the items as follows.
   Two-wheeled motorcycles and three-wheeled motorcycles with a sidecar shall be equipped with a braking system that meets the requirements of any one of the following items:
Newly insert the following items under Article 67, paragraph 1, subparagraph 4.
    A. A main braking system in which the front and rear wheels operate independently of each other;
    B. A divided braking system in which there are one or more brakes for each of the front and rear wheels.
In the main sentence of Article 67, paragraph 1, subparagraph 5, change “a parking brake system and the following” to “the following,” and change the items as follows.
    A. A three-wheeled motorcycle with a displacement of not more than 50 cc and maximum speed of not more than 50 kilometers per hour shall be equipped with a parking brake system and a main braking system that corresponds to any one of the following:
      1) A main braking system where the front and rear wheels operate independently from each other;
      2) A divided braking system;
      3) A combined braking system and auxiliary braking system.
    B. A three-wheeled motorcycle with a displacement of more than 50 cc or a maximum speed of more than 50 kilometers per hour shall be equipped with a parking brake system and a foot-operated (methods other than foot operation may be used in the case of vehicles for persons with disabilities) main braking system that corresponds to any one of the following:
      1) A divided braking system;
      2) A combined braking system and auxiliary braking system.
Newly insert Article 67, paragraph 1, subparagraph 8-2 as follows.
  8-2. Any two-wheeled motorcycle with a displacement of more than 125 cc or a maximum output of more than 11 kilowatts shall be fitted with an anti-lock braking system as its main braking system.
Newly insert a proviso to Article 89, paragraph 1 excluding the subparagraphs.
  Provided, that a passenger vehicle that meets the requirements of the attached Table 14 shall be construed as having satisfied these requirements.
Newly insert a proviso in Article 91, paragraph 1 excluding the subparagraphs.
  Provided, that a passenger vehicle that meets the requirements of the attached Table 14 shall be construed as having satisfied the fuel system requirements for fixed barrier head-on impact.
In Article 92, change “motor vehicles and convertible motor vehicles that meet the dynamic rollover test requirements in the attached Table 14” to “convertible motor vehicles.”
Change the main sentence of Article 102, paragraph 1 as follows.
  Passenger vehicles shall meet the requirements of the attached Tables 14 and 14-2, and trucks with a gross vehicle weight of not more than 3.5 tons shall meet the requirements of the attached Table 14-2.
In Article 102, paragraph 2, change “minibuses” to “minibuses and towed motor vehicles.”
In Article 115, change “of a manufactured motor vehicle” to “suggested concerning a manufactured motor vehicle by its manufacturer, etc.”
In the footnotes of the attached Table 2, newly insert number 17 as follows.
17. Where a single indicator is used for both the automatic air bag malfunction indicator and the automatic side air bag malfunction indicator, an “automatic air bag malfunction indicator” shall be used.
Change the attached Tables 5-13, 11-3, 11-5, 14, 14-2, and 32-2 as per the appendices.
In the footnotes of the attached Table 33, newly insert number 4 as follows.
4. The allowable deviations herein shall not apply to specifications in the detailed criteria by size in attached Table 1, subparagraph 1 of the Enforcement Rule of the Motor Vehicle Management Act, or to specifications on which the applicability of these Rules are based.


Addenda

Article 1 (Enforcement Date) These Rules shall enter into force as of the day of promulgation; provided that the amended provisions specified in the following subparagraphs shall enter into force as of the respective dates:
  1. Article 49, attached Table 32-2: on a day 6 months after the date of promulgation
  2. Article 13: on a day 2 years after the date of promulgation
  3. Attached Table 2: January 10, 2019
  4. Article 67, subparagraph 8-2: January 1, 2020
  5. Articles 89, 91, and 102; attached Tables 11-3, 11-5, 14, and 14-2: September 1, 2020
Article 2 (General Applicability) The amended provisions herein shall apply to motor vehicles that are manufactured, assembled, or imported after the enforcement of these Rules.
Article 3 (Applicability concerning Identification and Lighting Requirements for Hand-operated Controllers and Indicators, etc.) The amended provisions of the attached Table 2 shall apply to motor vehicle models that are developed, manufactured, assembled, or imported after the enforcement of these Rules.
Article 4 (Transitional Measures for Anti-lock Braking Systems as the Main Braking System of Two-wheeled Motor Vehicles) Notwithstanding the amended provisions of Article 67, subparagraph 8-2, the former provisions shall apply to motor vehicle models that are being manufactured, assembled, or imported at the time of the enforcement of these Rules until December 31, 2020.
Article 5 (Transitional Measures for Impact Tests, etc.) Notwithstanding the amended provisions of Articles 89, 91, and 102 and the attached Tables 11-3, 11-5, 14, and 14-2, the former provisions shall apply to motor vehicles models that are being manufactured, assembled, or imported at the time of enforcement of these Rules until December 31, 2021.
