(1) Reasons for Proposal
The Enforcement Rule of the Ship Personnel Act was amended (to be enforced as of Jan. 1, 2019), in accordance with the amendments to the Standards of Training, Certification and Watchkeeping (hereinafter referred to as STCW Convention) following the adoption of the Mandatory Code for Ships Operating in Polar Waters (Polar Code) of the International Maritime Organization (IMO), in such a way that polar training programs (basic/job training) shall be included in stipulatory training; and that on board remote training (for those planning to board seagoing commercial ships) shall be added to the scope of training required for licenses based on service career without graduating from a designated education institute (maritime high school, maritime university, etc.).
However, in such amendment process, now it has become unclear whether ‘persons on board non-seagoing commercial ships’ who were previously subject to license acquisition training are still subject to such training, making it neccessary to clarify this matter with this Amendment.
(2) Major Provisions
A. Newly establish basic and job training program for ships operating in polar waters (attached Table 1)
Prescribe basic training and job training for ships operating in polar waters in the attached Table to the Enforcement Rule of the Ship Personnel Act to adopt the amended contents of the STCW Convention in domestic law, etc.
Newly establish addenda requiring seafarers on board ships operating in polar waters approved on or before Jul. 1, 2018 to either fulfill three (3) months of experience operating in polar waters by Jul. 1, 2020 or complete relevant training programs.
B. Resolve vagueness concerning persons subject to license acquisition training (attached Table 1)
Stipulate that ‘persons planning to board non-seagoing commercial ships’ are required to receive license acquisition training (three (3) or five (5) days), which is the samee as before to clearly establish that ‘persons planning to board non-seagoing commercial ships (coastal ships, etc.) are also subject to license acquisition training.
