(1) Reasons for Proposal

The Amendment newly inserts an obligation to inform any tenant who moves in prior to registration of the rental business entity certificate; newly inserts provisions to prescribe that where private rental housing is transferred between rental business entities, the transferee shall be construed as having filed a change report; and otherwise addresses and improves upon a number of weaknesses that have emerged from the operation of the current system.

(2) Major Provisions

A. Inform any lessee who has moved in prior to registration of the business registration certificate (Article 2, paragraph 6)

Where a lessee has already moved in prior to rental business entity registration, it is difficult for him or her to determine whether the lessor is a registered rental business entity until a rental agreement is entered into or modified. Accordingly, the Amendment requires the lessor to notify the lessee of his or her rental business entity registration immediately upon registration.

B. Where private rental housing is transferred between business entities, construe the transferee as having filed a change report (Article 15, paragraph 4)

Even if the transferor reports the transfer of the private rental housing, the transferee is required to visit the local government and file a separate change report, causing inconvenience. Accordingly, the Amendment prescribes that where a transfer report has been accepted, the transferee shall be construed as having filed a change report.
