(1) Reasons for Proposal
The Trucking Transport Business Act was amended (Act no. 15743; promulgated on August 14, 2018) to restrict felons from working in parcel delivery, strengthen penalties against persons who unlawfully dismantle speed limiters, prescribe compulsory refresher training for trucking employees, ensure the effectiveness of penalties against trucking employees collecting unfair charges, and prevent illicit recipients of fuel cost subsidies, and this Amendment specifies matters necessary for the enforcement thereof.
(2) Major Provisions
A. Specify that “types of trucking transport services specified by Presidential Decree” delegated in Article 9-2, paragraph 1 of the Act shall refer to a trucking transport service that collects, sorts, and delivers cargo
B. Specify that the “period specified by Presidential Decree” delegated in Article 9-2, paragraph 1, subparagraph 1 of the Act shall be equivalent to that of passenger transport services providing face-to-face services to ensure legal fairness
C. Specify that “informative data specified by Presidential Decree” delegated in Article 62, paragraph 2 of the Act shall refer to driver's licenses relevant to the eligibility for fuel cost subsidies, revocation of truck driver qualifications, failure to purchase compulsory insurance, etc.
D. Prescribe criteria for administrative penalties against relevant violations in accordance with obligations for trucking business operators, etc., that have been added in accordance with the amended Act
