(1) Reasons for Proposal

In accordance with the amended Pilotage Act (Act no. 15783; promulgated on September 18, 2018; to be enforced on December 19, 2018), this Amendment prescribes matters concerning the designation criteria and procedure for pilots essential to the nation delegated to the Ordinance of the Ministry of Oceans and Fisheries, and newly inserts provisions concerning the extension of retirement age for pilots essential to the nation.

(2) Major Provisions

A. Criteria and procedure for designation of pilots essential to the nation (Article 9-2, 9-3, and 9-4 newly inserted)

1) Newly insert the designation criteria and procedure for pilots essential to the nation as delegated by Article 6-3 of the amended Pilotage Act; and ensure the smooth and safe provision of pilotage services by restricting eligibility to Class 1 pilots with no history of accidents punishable by suspension from performing pilotage services or greater punishment within the most recent 3-year period

2) Clarify the designation procedure for pilots essential to the nation by specifying matters concerning designation applications, reviews, and the issuance and return of designation certificates, and prescribe that pilots essential to the nation shall be designated in each national fiscal year

B. Extension of retirement age for pilots essential to the nation (Article 9-5 newly inserted)

Newly insert a method for extending the retirement age for pilots essential to the nation as delegated in the proviso of Article 7 of the amended Pilotage Act; and prescribe that where the designation of a pilot essential to the nation is revoked or is cancelled by the pilot’s request, any extension of the retirement age shall also be terminated at the same time
