(1) Reasons for Proposal

In accordance with the amendment and promulgation of the Cosmetics Act (Act no. 15488; March 13, 2018), this Amendment lays the groundwork for regulatory enforcement by incorporating the amended matters prior to the enforcement of the Act.

(2) Major Provisions
A. Prescribe detailed regulations following the switch to an a prior reporting system for lists of raw materials (Article 13 amended)

1) The amended Act (Act no. 15488; March 13, 2018) enforces an a prior reporting system requiring lists of raw materials used to manufacture cosmetics in the previous year to be reported before the distribution and sale of the cosmetics, instead of an post reporting system requiring the lists to be reported by the end of February of the following year.

2) Accordingly, prescribe detailed regulations concerning such matters as the a prior reporting of lists of raw materials and the reporting of modifications, etc., to ensure the successful implementation of the scheme

B. Prescribe procedures for periodic safety reviews of the designated and publicly announced standards for the usage of raw materials for cosmetics, and prescribe procedures for applications to change the standards for usage (Article 17-2, Article 17-3, etc. newly inserted)

1) The amended Act (Act no. 15488; March 13, 2018) prescribes periodic reviews of the safety of the designated and publicly announced standards for the usage of raw materials for cosmetics, and grounds on which cosmetics manufacturers, etc., may request changes to the standards for usage.

2) Accordingly, prescribe detailed regulations concerning the frequency and procedures of the periodic safety reviews and changes to the standards for usage to ensure the successful implementation of the scheme

C. Prescribe a certification system for natural and organic cosmetics, and measures to designate and operate certification agencies (Article 23-2, Article 23-3 newly inserted)

1) The amended Act (Act no. 15488; March 13, 2018) newly inserted a definition of natural cosmetics, thus prescribing grounds to establish a certification system for natural and organic cosmetics and designate certification agencies.

2) Accordingly, prescribe detailed regulations concerning procedures for natural and organic cosmetics certification applications and extension applications, designation criteria for certification agencies, and other operational measures to ensure the successful implementation of the scheme

D. Prescribe qualification requirements, etc., for consumer monitors of cosmetics safety control (Article 26-2 newly inserted)

1) The amended Act (Act no. 15488; March 13, 2018) prescribes grounds to introduce consumer monitoring of cosmetics safety control.

2) Accordingly, prescribe detailed regulations concerning such matters as the qualification, term of office, duties, and education of consumer monitors of cosmetics safety control to ensure the successful implementation of the scheme

E. Reflect other changes to names and provisions, deleted provisions, etc. (Article 3, Article 9, Article 31, etc. amended; Article 16 deleted)

1) The amended Act (Act no. 15488; March 13, 2018) changes the name “cosmetics manufacturing-selling business” to “responsible distribution business,” transfers the subcategories of businesses to the Presidential Decree, increases the scope of persons entitled to request examinations of and reports on functional cosmetics, and deletes regulations on permissions to export or import endangered species of wild fauna and flora due to repetition.

2) Accordingly, reflect the changes to names and cited provisions, etc., in the amended Act
