(1) Reasons for Proposal

This Amendment aims to enhance the rationality of the TV license fee collection system, such as addressing public inconveniences involved in paying TV license fees.

(2) Major Provisions

A. Simplify the procedures for exempting TV license fees (Amendment to Article 44, paragraph 2 of the Enforcement Decree of the Broadcasting Act)

Expand the scope of eligibility for exemption from TV license fees without additional documentary evidence with respect to the persons eligible for exemption from TV license fees pursuant to Article 44 of the Enforcement Decree of the Broadcasting Act

B. Obligate KBS or the entrusted TV license fee collection agency to publicly announce the system of TV license fee reduction (Article 45, paragraph 4 of the Enforcement Decree of the Broadcasting Act newly inserted)

Obligate KBS or the entrusted TV license fee collection agency to publicly announce the TV license fee reduction system to ensure that the persons liable to pay TV license fees are cognizant of the system, considering that not many people are familiar with the TV license fee reduction system under Article 45 of the Enforcement Decree of the Broadcasting Act

C. Newly establish the basis for refunding the TV license fees erroneously paid by nonowners of TV receivers (Amendment to Article 46 of the Enforcement Decree of the Broadcasting Act)

Provide the basis for refunding the TV license fees erroneously paid by nonowners of TV sets, given that multiple civil complaints have been filed demanding a refund of the TV license fees erroneously imposed on nonowners of TV sets since Article 46 of the Enforcement Decree of the Broadcasting Act only prescribes the legal basis for refunding the TV license fees overpaid by registrants of TV sets

D. Lower the rate of additional charge in case TV license fees are in arrears (Amendment to Article 47, paragraph 1 of the Enforcement Decree of the Broadcasting Act)

Lower the rate of additional charge from the current 5% to 3% in fairness to other charges with their legal nature similar to that of the TV license fees when TV license fees as prescribed in Article 47, paragraph 1 of the Enforcement Decree of the Broadcasting Act are in arrears, and make it obligatory to notify the legal basis for imposing this additional charge in reminders for payment

E. Modify the clauses relating to exemption from registration of TV sets, and from payment of TV license fees (Amendments to Article 39 and Article 44 of the Enforcement Decree of the Broadcasting Act)

Increase legal systematicity by rearranging the order of the subparagraphs under the category of eligibility for exemption from registration of TV sets under Article 39 of the Enforcement Decree of the Broadcasting Act and those under the category of eligibility for exemption from payment of TV license fees under Article 44 of the same Decree, taking the importance and similarity of the grounds for exemption into account
