(1) Reasons for Proposal

The Amendment ensures the effectiveness of administrative penalties by prescribing that cases where a violation of the payment deadline for a subcontract price is remedied before receiving a correction order shall be construed as having been administered with punishment. It also recognizes protected horticulture technicians who perform duties associated with greenhouse facility installation under the standards for registration of construction business (technical capacity) since greenhouse installation work is included in the scope of metallic and joinery construction businesses.

(2) Major Provisions

A. Prescribe that cases where a violation specified in Article 81, subparagraphs 4 and 6 of the Framework Act on the Construction Industry is remedied before a correction order is received shall be construed as having been administered with punishment (Chapter 7 of the Management Regulations)

B. Prescribe that among the “holders of technical qualifications in relevant areas under the National Technical Qualifications Act,” protected horticulture technicians who perform duties associated with greenhouse installation for a metallic and joinery construction business shall be recognized under the standards for registration of construction business (technical capacity) (Appendix 5, Specialized Construction Businesses, 7. Metallic and Joinery Construction Business)
