(1) Reasons for Proposal
The Act on Protective Action Guidelines against Radiation in the Natural Environment was revised to prohibit the manufacture, importation and exportation of products that have been specified by the Nuclear Safety and Security Commission and published, such as products closely contacting a human body or products worn by persons, etc., for which raw materials or by-products from processing are used (promulgated on January 15, 2019; to be enforced on July 16, 2019). Accordingly, the Amendment aims to prescribe the types of prohibited products concerned.

 

(2) Major Provisions
A. General criteria for processed products using raw materials or by-products from processing, the manufacture, importation and exportation of which are prohibited (Subparagraph 1 of the attached Table)
1) Processed products that shall be prohibited from being manufactured and imported and/or exported shall consist of materials containing a natural radionuclide, such as Uranium 235, Uranium 235 and Thorium 232 or nuclides in radioactive decay series;
2) Processed products subject to prohibition shall include parts and accessories thereof;
3) Where, although the types and names, etc., of processed products indicated or advertised by manufacturers are different from those of processed products subject to prohibition, the relevant processed products are being used by closely contacting a human body or being worn by people in a similar manner with processed products subject to prohibition, the relevant processed products shall be deemed those publicly specified as subject to prohibition;
4) Standards for determining products subject to prohibition shall not depend on, or be different in accordance with, the existence or lack of specific functions, materials, objects of use or purpose of processed products.
B. Detailed classification of products subject to prohibition according to manner of use, such as close contact with a human body or wearing by people (Subparagraph 2 of the attached Table)
1) Products that a person lies on, covers him/herself with or uses: bed, mattress, bedclothes and pillow, etc.;
2) Products that a person puts on the floor or sits on: mat, floor paper, sitting cushion, sofa and chair, etc.;
3) Products that a person wears or sticks on a human body or clothes: jewelry and accessories, masks, clothes, sanitary napkins, etc.;
4) Products that a person applies, rubs or sprays on a human body, and products for bath and cleaning, etc.: cosmetics, cleanser and toothbrush, etc.;
5) Products for cooking and refection by containing or contacting food or ingredients: spoon, chopsticks, pot, cutting board, kitchen knife, dish, plate and cup, etc.;
6) Toys, writing supplies, and strollers
