(1) Reasons for Proposal
The amendment aims to improve and complement a number of weaknesses that have emerged in the operation of the current system by securing the effectiveness of the introduced system by including the non-installment of a Sleeping Child Check Bell in a motor vehicle for passengers and freight into disapproved items of motor vehicle inspection, by shortening the re-inspection period of motor vehicles which are disapproved in the exhaust gas test at regular inspections and making it mandatory to install exhaust gas capture facilities to reduce air pollution caused by motor vehicle exhaust gas, by decreasing the management burden of repair and approval institutions by liberalizing the fee for repair and approval of taxis, etc.
(2) Major Provisions
A. Add the non-installation of a Sleeping Child Check Bell or the safety standard violation to the disapproved items of motor vehicle inspection (Article 80 (2))
○ Since the installation of a Sleeping Child Check Bell is mandatory to motor vehicles for passengers and freight for children's transportation to prevent accidents caused by child neglect in motor vehicles due to drivers’ carelessness, this amendment aims to improve the effectiveness of the system by adding the failure to install the Sleeping Child Check Bell to the disapproved items of motor vehicle inspection.
B. Shorten the re-inspection period of motor vehicles which are disapproved in the exhaust gas test (Article 81 (1) 2 (C) newly inserted)
○ This amendment aims to contribute to the prevention of air pollution by restricting the operation of non-compliant vehicles on roads by shortening the re-inspection period of motor vehicles which are disapproved in exhaust gas tests at regular inspections.
C. Only for the exclusions of motor vehicle maintenance business, omit the regulation on an estimate of checkup and maintenance service, such as replacement of simple consumables (Article 134)
○ The self-employed who perform the exclusions of motor vehicle maintenance business, such as replacement of simple consumables of motor vehicles, have no obligation to issue an estimate of checkup and maintenance service, whereas registered motor vehicle maintenance business operators who perform even the same repair work must issue an estimate of checkup and maintenance service, which acts as an excessive regulation. Therefore, deregulate so that motor vehicle maintenance business operators may omit an estimate of checkup and maintenance service when performing maintenance works falling under the exclusions of motor vehicle maintenance business.
D. Establish standards for the precision test of headlight testers (attached Table 12)
○ Since the headlight test standard among the automobile inspection standards will be changed from a high beam test to a low beam test from 2020, it is also necessary to establish standards for the precision test of headlight testers.
E. Make it also mandatory to install exhaust gas capture facilities at regular inspections of motor vehicles (No. 2 of attached Table 16 and No. 1 of attached Table 18)
○ Since the exhaust gas generated during regular inspections is directly discharged into the air and pollutes the air environment due to no exhaust gas capture facility during regular inspections, whereas exhaust gas capture facilities are used during comprehensive inspections, this amendment aims to contribute to the prevention of air pollution by making the installation of exhaust gas capture facilities mandatory even during regular inspections.
F. Liberalize the fee for repair and approval of taxi meters (attached Table 30 and attached Form No. 59)
○ According to Article 76 of the Motor Vehicle Management Act, the fee for repair and approval shall be determined by official approval institutions specialized in taximeters, but the fee is set at 3,000 won in the Enforcement Regulations of the Motor Vehicle Management Act, which is a violation of a superordinate law. Therefore, this amendment aims to liberalize the fee for repair and approval as the amount determined by approval institutions like as other taxi meter approval fees such as the fee for manufacturing approval and fee for use approval.
