(1) Reasons for Proposal
The Amendment aims to provide consumers with accurate information by requiring the names and content of nutritional/functional components to be indicated on the principal display panel, and a “nutrition/function information label” and “precautions for use” to be placed on the information panel.
It also clarifies provisions on the labeling of miscellaneous ingredients in order to prevent consumer misunderstanding and confusion caused by labels emphasizing miscellaneous ingredients, and otherwise addresses and improves upon a number of weaknesses that have emerged from the operation of the current system.
(2) Major Provisions
A. Insert new provisions on the labeling of the names and content of nutritional/functional components on the principal display panel (Article 5, subparagraph 2, item B)
1) It is difficult to provide accurate information to consumers when the principal display panel only indicates the names of nutritional components or functional ingredients.
2) Require principal display panels to indicate the names and content per daily intake of nutritional/functional components. Insert a new proviso to allow this information to be indicated on the information panel if not less than four nutritional/functional ingredients have been used.
B. Amend provisions on the location of nutritional/functional information, precautions for use, and other label particulars (Article 5, subparagraph 3, item B)
1) It is difficult for consumers to access “nutritional/functional information” and “precautions for use” when such information is provided in the package insert.
2) Amend provisions to prescribe that “nutritional/functional information” and “precautions for use” shall be indicated on the information panel.
C. Amend provisions on the labeling of miscellaneous ingredients (Article 6, subparagraph 9, item B and subparagraph 11, item H)
1) Displaying the content, photographs, or images of miscellaneous ingredients may mislead and confuse consumers into believing that the miscellaneous ingredients have functionality.
2) Clarify provisions to state that the content of miscellaneous ingredients may be indicated if the content of all ingredients are indicated in the ingredient names and content section.
3) Insert new provisions to restrict the separate indication of the names and content of miscellaneous ingredients unless in accordance with 2), and restrict the display of photographs, images, etc. of miscellaneous ingredients.
