(1) Reasons for Proposal
Since the Tourism Promotion Act has been revised to provide a basis for canceling the entrustment designation of safety inspection trusted institute for casino machine inspection and amusement facilities or amusement equipment safety inspection (Act No. 16684, promulgated on Dec. 3, 2019, and shall be implemented on Jun. 4, 2020), this amendment aims to determine matters entrusted by the Act and matters necessary for its enforcement, such as setting standards and detailed procedures for canceling the entrustment of inspection institute and suspension of business and to improve and remedy some of the operational shortcomings of the current system, such as the new establishment of designation requirements for the casino machine inspection institute and the application process for the designation.
(2) Major Provisions
A. Designation Requirements for Casino Machine Inspection Institute (Article 70-2 and attached Table 25 newly inserted)
The amendment clarifies the requirements of casino machine inspection agencies, such as personnel and equipment standards necessary for casino machine inspection, to enhance the reliability and professionalism of casino machine inspection.
B. Application Process for Casino Machine Inspection Institute (Article 71-2 newly inserted)
A person who wants to be designated as a casino inspection institute shall submit required documents attached to the designation application form to the Minister of Culture, Sports and Tourism, and if the person who submits the designated application is recognized that the designation requirements have been met, the Minister of Culture, Sports and Tourism may appoint him/her as a casino machine inspection institute.
C. Disposition Standards for Cancelling the Entrustment and Business Suspension of Inspection Agencies (Article 71-3 and attached Table 26 newly inserted)
This amendment establishes the disposition standards for violations prescribed by the Act, such as that an inspection institute has been selected as an entrusted business operator by a false or fraudulent means or that an inspection institute has conducted an inspection in a false or fraudulent way. When canceling the entrustment of an inspection institute or ordering suspension of business, such fact shall be published on the Internet home page without delay.
