(1) Reasons for Proposal

This amendment aims to specify the legal basis in relation to projects for promoting employment of the aged by establishing matters concerning the implementation of projects delegated to the Presidential Decree. Also, since the Act on Prohibition of Age Discrimination in Employment and Elderly Employment Promotion in regarding the provision (efforts) for reemployment support of business owners for the employees aged 50 years or older who plan to leave their job has been revised, this amendment intends to establish specific details for the enforcement of the Act, such as mandatorily eligible persons, scope and contents, and to improve regulations such as the review of other regulations, handling personally identifiable information, and provisions in respect of the delegation of authority to the head of a regional employment and labor office.

(2) Major Provisions

A. Regulate the details related to the implementation of projects for elderly employment promotion (Article 9-2 (1) through (6) newly inserted)

Specify the basis for delegation and support of projects, etc., that the Minister of Employment and Labor may make to promote employment of the elderly in accordance with Article 11-4 of the Act.

B. Actualize matters regarding the payment of subsidies for employment (Article 11 newly inserted)

Add related regulations on payment criteria, etc., for Subsidies for Employment of Seniors Aged 60 Years or Older and Incentives for Continuous Employment of the Aged (Articles 25-2 and 28-4 of the Enforcement Decree of the Employment Insurance Act)

C. Specify the support of reemployment support service (Articles 14-2 through 14-4 newly inserted)

Regarding the provision (efforts) for reemployment support services of business owners for the employees aged 50 years or older who plan to leave their job, which shall be enforced from May 2020, the amendment aims to establish specific details necessary for the enforcement, such as business owners who have obligations to provide services, eligible workers, scope, and contents, which are mandated to the Enforcement Decree.

D. Add matters to the delegation of authority (Article 15)

Delegate to the head of a regional employment and labor office the matters concerning the implementation of job creation in the social sector under Article 9-2 (1) of the Act and the affairs of supporting business owners who provide reemployment support services under Article 21-3 (4) of the Enforcement Decree 

E. Re-examination of regulation (Article 15-2)

Actualize the re-examination time of the criteria for designation of talent banks of the aged from 2017 to 2020

F. Newly insert the matters on processing sensitive information and personally identifiable information (Article 15-3 newly inserted)

As matters on reemployment support service have been newly inserted in the Act, establish grounds for processing data including resident registration numbers, etc., to implement office work on service support, reporting, and inspection
