(1) Reasons for Proposal

In accordance with the amendment to the Aviation Business Act (Act No. 16642, promulgated on Nov. 26, 2019, to enter into force on May 27, 2020) which enabled the Minister of Land, Infrastructure and Transport to allocate or adjust landing slots to secure air transport safety, convenience of use, etc., while also preventing users of air transportation from staying on board an aircraft for an extended amount of time, this proposal aims to prescribe matters delegated to it under the Act and matters necessary for their enforcement such as matters necessary when applying for permission to exchange an allocated landing slot with another air transport service provider, matters to be reported to the Minister of Land, Infrastructure and Transport when a delay occurs in an aircraft within a movement area, etc.

As a follow-up measure to Strengthening Competitiveness of the Aviation Business (Dec. 19, 2019), this proposal also aims to reduce costs and time incurred by air transport service providers in obtaining permission to change business plans as a result of introduction or disposal of aircraft by changing to a reporting system, thereby streamlining administrative procedures and lead time; and

To improve and supplement certain shortcomings that have surfaced in the current system such as reducing the burden for foreign international air transport service providers by enabling minor changes in a foreign international air transport service provider’s business plan to be reported as in the case of an international air transport service provider rather than subject to permission.

(2) Major Provisions

A. Change in Business Plan Related to Introduction or Disposal of Aircraft (Article 18)

Prescribe that minor changes in a business plan related to introduction or disposal of an aircraft shall be reported to the Minister of Land, Infrastructure and Transport.

B. Application for Permission to Exchange Landing Slot (Article 23-2)

Prescribe detailed criteria and form to be applied when applying for permission in advance to exchange a landing slot between airline operators to the Minister of Land, Instructure and Transport.

C. Reporting Change in Business Plan by Foreign Air Transport Service Provider (Article 61)

Enable a foreign air transport service provider to make a report when making minor changes in its business plan such as change in aircraft type.
