(1) Reasons for Proposal
As the Harbor Act has been wholly revised (Act No. 16902, promulgated on January 29, 2020, and to be enforced on July 30, 2020) so that the Harbor Act and the Act on Port Redevelopment and Adjacent Area Development have been divided and the Managerial and Operational Rule of Harbor Hinterland Complexes has been newly established, this amendment aims to revise related provisions within the Enforcement Rules, determine matters delegated by upper statutes and their enforcement, such as rental permission conditions for exclusive purpose harbor facilities, etc., of non-management authorities, procedures and methods of access control in harbor areas, and the scope of new technology and remaining works that can be processed after terminating an occupancy agreement on a harbor hinterland complex, and improve and supplement a number of shortcomings in the operation of the current system.
(2) Major Provisions
A. Rental permission conditions for exclusive purpose harbor facilities, etc., of non-management authorities (Article 18)
Prescribe conditions for permitting the rental of exclusive purpose harbor facilities, etc., of non-management authorities in such cases where it is not rental of all the port facilities, etc., and where there is no resulting usage of or change to port facilities.
B. Procedures and methods of access control in harbor areas (Article 23)
Require providing 30 days notification of the reason for the designation of access control areas, locations, maps, etc., in the official gazette, information and communication media, and signs when attempting to control access to places in a harbor area with a high risk of casualties.
C. Scope and selection procedure of new technologies to be supported (Article 24)
Require that the scope of new technologies to be applied shall be certified in accordance with the Marine Science and Technology Promotion Act, Construction Technology Promotion Act, and other related Acts and shall be defined by new technologies, new construction methods, and patents within the validity period; and the new technology to be supported shall be determined after deliberation by the New Technology Utilization Deliberation Committee.
D. The scope of remaining works after terminating an occupancy agreement on a harbor hinterland complex (Article 37)
Limit the scope of remaining works after terminating an occupancy agreement on a harbor hinterland complex to the fulfillment of the export or import contract at the time of termination of the agreement and the inventory investigation and disposal of the goods.
