(1) Reasons for Proposal
In accordance with the public announcement last March 18th of the amendment to the Foreign Trade Act for improving the export control system including stronger maintenance of national security and safety, this Amendment aims to make improvements to matters necessary for enforcement of the Act such as matters regarding pre-training necessary for self-assessment and matters regarding registration of data on the information system for managing trade of strategic items, and also aims to clarify matters regarding entrusting the job of deciding strategic items to specialized institutions, etc.
(2) Major Provisions
A. Stipulation of institutions for deciding strategic items and clarification of decision-making work (Article 7)
- Stipulate the Korean Security Agency of Trade and Industry and the Korea Institute of Nuclear Nonproliferation and Control as decision-making institutions with respect to strategic items or items subject to authorization depending on circumstances, and specify the items subject to assessment, etc.
B. Stipulation of items, etc. authorized for specialized decision-making only (Article 12)
- Include items subject to attached Table 2 (Dual-Use Items) and Section 10 (Items for Nuclear-Only Use) in addition to technology currently subject only to specialized decision-making
C. Stipulation of matters regarding pre-training necessary for substantiation of self-assessment and registration of data necessary for decision-making, timing of effecting self-assessment reports, etc. (Articles 13, 20, 29)
D. Modification through integrating existing provisions on enabling request for submission of application documents for exempted individual authorizations where necessary (Article 21)
E. Clarification of application documents for comprehensive user export authorization and enabling end-user certificates to be submitted as application document in addition to end-consignee statement (Article 29)
F. Inclusion of filing for export without receiving export authorization as an act of violation (attached Table 22)
G. New insertion of definition of terms (Article 2) and change of terms (Article 65, etc.), etc.
