(1) Reasons for Proposal
This Partial Amendment aims to strengthen the management of Foreign Legal Consultants by terminating the registration of Foreign Legal Consultants if the valid period for their registration has expired as Foreign Legal Consultants are not diligent in applying for renewal of their registration and encourage Foreign Legal Consultants to voluntarily renew their registration, while improving and supplementing weaknesses arising from the operation of the current system by expanding membership requirements for the Foreign Legal Consultant Disciplinary Committee to allow even non-prosecutor high-ranking public officials to be appointed as members of the Foreign Legal Consultant of the Ministry of Justice.
(2) Major Provisions
1. Create a provision that terminates the registration of Foreign Legal Consultants if the valid period for their registration has expired
- Create a provision that terminates the registration of Foreign Legal Consultants when they do not renew their registration before the valid period for their registration (5 years) expires
2. Change the membership of the Foreign Legal Consultant Disciplinary Committee
- Create a clause that makes it mandatory to check with the Minister of Justice whether qualifications for the representative of a Foreign Legal Consultant Office are met when the representative is changed
- Delete the provision that appoints a Foreign Licensed Lawyer as a member if it is difficult to appoint a Foreign Legal Consultant
- Revise the provision about membership so that a non-prosecutor high-ranking public official in the Ministry of Justice (head of the Legal Affairs Bureau, etc.) can be appointed as a member of the Foreign Legal Consultant Disciplinary Committee of the Ministry of Justice
