(1) Reasons for Proposal

As gasoline stations, etc. that are closed due to business deterioration are abandoned for a long period of time without appropriate safety measures, they are exposed to various safety accident risks. This amendment aims to strengthen the safety management of factories, storage places, and handling places of hazardous substances, such as requiring safety measures to be taken if a factory, etc., intends to stop storing or handling hazardous substances for more than three months; requiring the plant, etc., to report the suspension to the Mayor/Do Governor 14 days prior to the date of stopping the storage or handling hazardous substances; ensuring that drivers of vehicles transporting hazardous substances meet certain requirements, such as obtaining national technical qualifications in the field of hazardous substances or receiving training related to the transportation of hazardous substances, and strengthening the safety management of vehicles transporting hazardous substances; requiring the drivers to take regular training after starting their work and punishing drivers of vehicles transporting hazardous substances for not fulfilling the requirements; and whereas in the past the results were only recorded and preserved by any person related to a factory, etc., handling large quantities of hazardous substances, they are now required to submit the results of inspection of the location, structure, and compliance with technical standards for facilities of a factory, etc., with hazardous substances to the Mayor/Do Governor within 30 days from the inspection date to strengthen the safety management scheme for factories, general handling places, etc., handling large quantities of hazardous substances.

(2) Major Provisions

A. Provide a basis for safety measures to report suspension if the storage/handling of hazardous substances is suspended for a certain period of time due to reasons such as poor management or large-scale construction changes (Article 11-2 newly inserted) 

B. Even though a person related to a factory, etc., has previously kept the results of regular inspections, they are now required to submit a copy of the results to the relevant fire station to confirm whether the inspection has been carried out, and others (Article 18 (2) newly inserted) 

C. Require any person who loads and transports hazardous substances stored in containers over a designated quantity to be regularly trained with certain qualifications (Article 20 (2) newly inserted and Article 28 (1)) 

D. Provide a basis for confirming the qualifications, etc., of drivers transporting hazardous substances by fire officers, etc., and clarify the matters of entry and inspection for tank testers (Article 22 (2) and (5)) 

E. Provide provisions for penalties for those who do not follow the order of safety measures for suspension (Article 36, subparagraph 3-2 newly inserted) 

F. Provide penalties for a person who loads and transports hazardous substances stored in containers in a vehicle over a certain quantity that do not meet the qualifications (Article 37, subparagraph 4-2 newly inserted) 

G. Reinforce the criteria for the provision of administrative fines that apply to violations of the detailed standards of safety management (storage, handling, and transport) that must be followed to prevent hazardous substance accidents (Article 39 (1)) 

H. Provide a basis for imposing an administrative fine on any person who fails to report a suspension within the period of time or reports falsely (Article 39, subparagraph 5-2 newly inserted) 

I. Provide a basis for imposing an administrative fine on any person who fails to submit the results of the regular inspection within the period of time (Article 39, subparagraph 7-2 newly inserted)
