(1) Reasons for Proposal

In accordance with the revision of the Marine Transportation Act (Feb. 21, 2020) to introduce the outstanding shipper and ship owner certification system, this enactment aims to determine the matters that the Minister of Oceans and Fisheries has set and announced and that are necessary for its implementation in the Enforcement Decree and the Regulations in relation to the operation of the outstanding shipper and ship owner certification system.

(2) Major Provisions

A. Certification application criteria (Article 3) 

- Set the criteria for applying for the certification as an international freight forwarder with annual sales of 10 billion won or more in the previous year or an import and export enterprise with annual sales of 100 billion won or more and an enterprise whose liner route stops at ROK ports at least once a week for a provider of scheduled overseas cargo transportation services

B. Review items and points (Article 4) 

- Set review items and points as in attached Table 1

C. Establishment and operation of the certification review committee (Article 5) 

- Require the head of a dedicated certification agency to establish/operate a certification review committee of five or more and not exceeding nine members consisting of shipping/logistics/trade-related professors, research institutes, and executives of organizations

D. Organization of a certification evaluation team (Article 6) 

- Require the head of the dedicated certification agency to organize/operate a certification evaluation team of 50 or more to secure the expertise for certification review

E. Duties of the certification-dedicated agency (Article 8) 

- The dedicated certification agency shall perform duties such as the organization/operation of the certification review committee and certification evaluation team, the establishment of certification review and inspection plans, and the preparation of detailed inspection criteria.

F. Certification criteria and classes (Article 9) 

- To be certified, the sum of the scores for each review item shall be 70 points or more and 20% or more of the points for each review item. The criteria grant 80 points or more to first class and 70 points or more to second class.

G. Reissuance of certificates (Article 10) 

- If the certificate is lost/damaged or there is any change in the stated matters, the certified enterprise shall apply for the reissuance of the certificate to the head of the dedicated certification agency , and the head of the dedicated certification agency shall check the documentary evidence and request reissuance from the Minister of Oceans and Fisheries.

H. Inspection of certified enterprises (Article 11) 

- Any certified enterprise that has been notified of a certification inspection date shall submit an application for the inspection of the outstanding shipper and ship owner certification to the head of the dedicated certification agency, who shall evaluate whether the certification criteria are maintained, and if the results of the inspection, etc., fall under the reason for certification cancellation, he/she may request the Minister of Oceans and Fisheries to cancel the certification.

I. Objection regarding the inspection, etc. (Article 12) 

- If an applicant for certification has an objection to the results of the certification review and inspection, he/she may file an appeal within 14 days of the date the results are notified.
