(1) Reasons for Proposal

As the provisions related to fishing vessel safety management and aquaculture business based on the Fisheries Act were separated and/or integrated to be enacted and enforced under the Fishing Vessel Safety Operations Act and the Aquaculture Industry Development Act, partial revisions are required to change referenced provisions related to the existing administrative disposition based on the Fisheries Act and reflect new provisions.

(2) Major Provisions

A. Provide the basic standards within the Rules on Standards and Procedures for Administrative Measures for Violations of the Fisheries-Related Statutes (hereinafter referred to as the “Rules”) 

 Clearly set forth that the Rules are for the enforcement of the items entrusted by the Fishing Vessel Safety Operations Act and the Aquaculture Industry Development Act (Articles 1 and 2 and Article 3 (1) and (3))

B. Add provisions related to the request criteria for administrative disposition and its procedures 

 Add basis provisions for implementation of administrative dispositions under the Fishing Vessel Safety Operations Act and the Aquaculture Industry Development Act (Article 4, Article 6 (1) and (2), Article 7 (7), and attached Table Ⅰ. 1·2·4·6)

C. Change the basis for referencing administrative dispositions in accordance with the current Rules for Vessel Safety Operations 

 Collectively delete the administrative disposition criteria based on the existing Rules for Vessel Safety Operations and change them to the criteria under the Fishing Vessel Safety Operations Act (attached Table Ⅱ.2. (d) newly inserted)

D. Newly establish administrative disposition criteria related to the violation of restrictions on departures upon the announcement of severe weather threat 

 Newly establish administrative dispositions for the violation of restrictions on departures and obligations upon the announcement of severe weather threat pursuant to Article 10 of the Fishing Vessel Safety Operations Act (attached Table Ⅱ.2. (d) 2)

E. Change the referenced provisions related to the aquaculture license separated from the Fisheries Act 

 Partially delete the violations that have been separated from licensed fishery businesses into aquaculture licenses and change them to the standards under the Aquaculture Industry Development Act (attached Table Ⅱ.1. (d) newly inserted)

F. Change the referenced provisions related to permission of aquaculture businesses separated from the Fisheries Act 

 Partially delete the violations that have been separated from permitted fishery businesses into aquaculture licenses and change them to the standards under the Aquaculture Industry Development Act (attached Table Ⅱ.2. (e) newly inserted)

G. Change the administrative disposition criteria for some violations related to aquaculture licenses and permits 

 Change the criteria for the effective administrative disposition of violations of existing aquaculture licenses and permits (attached Table Ⅱ.1. (d) No. 16·20 and Table Ⅱ.2. (e) No. 5·6·9·12·13·16~20)

H. Newly establish administrative disposition criteria for violations of possession, distribution, processing, and storage of aquatic products 

 Newly establish administrative disposition for violations, such as the sale of marine products illegally farmed in accordance with Article 57 of the Aquaculture Industry Development Act (attached Table Ⅱ.1. (d) 24 newly inserted)
