(1)Reasons for Proposal

 The suggestions raised in a conference organized by the Ministry of Government Legislation Interpretation in 2015, the laws that need to be revised (requiring grounds for the laws) when revising the sub-statutes in 2017, and unreasonable matters subject to statutory improvement have been appointed as legislation in 2018,

 which ensures predictability so that port facility users are able to know what items are prohibited from being carried in.

(2) Major Provisions

 Subdivide the targets of hazardous items that are prohibited from being carried into port facilities or ships in port facilities (Article 2 attached Table of the Notice of Prohibited Hazardous Items into Port Facilities and Ships)

Remarks

1. Guns, rifles, and devices or similar devices that fire bullets designed to cause serious injury, including:

1) All types of firearms including pistols, revolvers, rifles, and shotguns

2) Compressed air guns and gas-filled guns

3) Components of firearms

· Carrying these items as checked baggage is possible only when bullets have been unloaded and then locked in a hard-sided container after the relevant documents have been checked, such as a firearm carry permit or an import/export license, by the relevant passenger ship transportation business operator.

Among the components of firearms, the sight may be carried in cabins.

4) Replicas and imitation firearms that may be mistaken for real weapons

5) Flare guns

6) Bows, crossbows, arrows, spears, throwing stars, and darts

7) Spearguns

8) Slingshots

· Toy bows, crossbows, arrows, and water guns may be carried in cabins

2. Devices specially designed to stun or paralyze, including:

1) Firearms and rod-type electric stunners

2) Electric stunners for animals

3) Chemicals and sprays used to disable, such as tear gas, pepper sprays, acid sprays, animal sprays

· When carrying electric stunners as checked baggage, the relevant documents, such as a firearm carry permit or an import/export license, shall be checked by the relevant passenger ship transportation business operator.

· When carrying a self-defense spray, such as tear gas, as checked baggage, only one spray per person (less than 100ml) is allowed.

3. Objects with sharp points or sharp edges that may be used to cause injury, including:

1) Items designed for cutting, such as axes, hand axes, and large kitchen knives

2) Ice axes and ice picks

3) Razor blades, cutter blades, Swiss army knives (folding knives), surgical scalpels

4) Knives with a blade longer than 6 cm, excluding 3)

5) Scissors with a blade longer than 6 cm

6) Martial arts supplies with sharp points or sharp edges

7) Swords and sabers (knives used in fencing games)

· Butter knives with a dull blade, razors with a safety blade, safety razor blades, electric shavers, and knives only for onboard meals (only owned by a ship operator) may be carried in cabins.

4. Tools that may be used to cause serious injury or threaten the safety of the ship, including:

1) Hammers and crowbars

2) Drills (including portable cordless drill) and drill components

3) Tools with a metal part longer than 6 cm except for handles, such as screwdrivers and chisels, that may be used as weapons.

4) Saws (including portable cordless power saws)

5) Bolt guns and nail guns

5. Blunt objects and sporting goods that may be used to cause serious injury when striking, including:

1) Baseball bats and softball bats

2) Dumbbells and bowling balls

3) Ice skates

4) Clubs and handcuffs, such as batons and nightsticks,

5) Martial arts supplies

· Balls and balloons, such as soccer balls with more than 1/3 of the air injected, are prohibited from being carried in as cabin baggage or checked baggage.

· Convoy equipment such as handcuffs for public purposes including convoys of criminals may be carried in cabins.

6. Explosives and flammable materials and devices that may be used to threaten the safety of the ship or cause serious injury, including:

1) Ammunition (real, blank, etc.)

2) Replica or imitation explosive devices

· When ammunition is carried in as checked baggage, the approval of the passenger ship transportation business operator shall be required.

Substances and devices that may be used to threaten the safety of the ship or cause serious injury, including:

Remarks

1. Alcoholic beverages

1) Alcoholic beverages over 70 degrees are prohibited from being carried in as cabin baggage or checked baggage, but only up to 5 liters of alcoholic beverages of 24 degrees or more but less than 70 degrees per person may be carried in as cabin baggage or checked baggage.

· Alcoholic beverages less than 24 degrees may be carried in as cabin baggage or checked baggage.

3. Exploders and fuses

4. Land mines, grenades, and other military explosives

5. Firecrackers and flares

6. Smoke shells

7. Dynamite, gunpowder, and plastic explosives

8. Torches

· However, if separated from fuel, it is possible to carry it as cabin baggage or checked baggage.

9. Flammable gas and flammable liquid

10. Infectious/biological hazardous substances and toxic substances (poisons, pesticides, etc.)

1. Items that are determined to be potentially hazardous by the security check supervisor of the relevant port during the security check, even if they are allowed on board or not prescribed in the above Table, may be prohibited from being carried onboard the ship or treated as checked baggage. 

2. If a substance to be carried in is a chemical/toxic substance, it may be carried in as checked baggage only if it is determined to be a safe material by presenting the material safety data sheet in accordance with the Occupational Safety and Health Act.
