(1) Reasons for Proposal
Following the revision of the Housing Act (promulgated on Jan. 23, 2020, and to be enforced on Jan. 24, 2021), which includes preliminary visits by prospective residents and the introduction of a multi-family housing quality inspection team system to improve the quality of multi-unit housing, this amendment aims to specifically determine the procedures and methods for preliminary visits by prospective residents entrusted by the Act and matters necessary for the installation and operation of the multi-family housing quality inspection team.
(2) Major Provisions
A. Preparation of an action plan for the results of prospective residents' preliminary visits (Article 20-2 newly inserted). When establishing an action plan for defects that prospective residents request to be repaired as a result of preliminary visits, require the project operator to prepare a plan including the defects by household and the method and schedule of actions for each defect type.
B. Procedures and methods for preliminary visits of prospective residents (Article 20-3 newly inserted). In the case of a building with more than 300 households, require the project operator to allow preliminary visits for at least 45 days before the commencement of the specified period of occupancy prescribed in the housing supply agreement (for less than 300 households, 35 days); to establish a preliminary visit plan one month before the start date of the preliminary visits and submit it to the pre-use inspection authority; and to provide checklists necessary for preliminary visits to prospective residents.
C. Inspection procedures of multi-family housing quality inspection team (Article 20-4 newly inserted)
1) Require that the pre-use inspection authority that received the preliminary visit plan from a project operator requests a quality inspection from the Mayor/Do Governor without delay, and the Mayor/Do Governor has a multi-family housing quality inspection team perform a quality inspection within 10 days from the end date of the preliminary visits, and
2) Require that the Mayor/Do Governor notifies the pre-use inspection authority and the project operator of the inspection seven days before the quality inspection team conducts the inspection, while the pre-use inspection authority who has been notified of the inspection plan selects at least five households to inspect areas for exclusive use, and the quality inspection team submits the inspection results to the Mayor/Do Governor and the pre-use inspection authority within 5 days of the inspection end date.
D. Request for data from the pre-use inspection authority (Article 20-5) For the inspection by a quality inspection team such as the construction status of multi-family housing, stipulate documents and related data that can be requested from the project operator by the pre-use inspection authority.
