(1) Reasons for Proposal

Persons in special types of employment are exposed to the risk of unemployment and are in great need of social and economic protection; however, they are not eligible for employment insurance because the Employment Insurance Act lacks specific provisions related to the matter. This Review aims to apply employment insurance to unemployed persons in special types of employment to support their livelihood and job seeking, and accordingly collect employment insurance premiums by amending the Act on the Collection of Insurance Premiums. etc. for Employment Insurance and Industrial Accident Compensation Insurance.  Moreover, the Review intends to reduce industrial accident insurance premiums for certain special types of employment, concerning the industrial accident rate, subject to the Industrial Accident Compensation Insurance Act, ease the burden of such insurance premiums, increase the number of industrial accident insurance policyholders, and thus protect them from industrial accidents.  

(2) Major Provisions

A. Oblige persons in special types of employment subject to the Employment Insurance Act to buy employment insurance and impose obligations on business owners of a labor provision platform business to report the commencement of a contract related to the use of such a platform and to cooperate in providing data related to the collection of insurance premiums (Article 48-3, paragraphs 1, 6, and 7, newly inserted)

B. Prescribe the subject bearing the insurance premium, the allocation ratio, the insurance premium rate, the computation of the monthly insurance premium, the withholding deduction of insurance premiums, the settlement of the insurance premium, and other matters related to the application of employment insurance to persons in special types of employment (Article 16-3, Article 16-9, Article 48-3, paragraphs 2 to 5, newly inserted)   

C. Provide business owners of a labor provision platform business with grounds for concluding a contract on conducting insurance management business such as payment of insurance premiums, etc. by proxy and prescribe supporting grounds thereof (Article 48-3, paragraphs 8 to 11)

D. Modify provisions according to the application of employment insurance to persons in other special types of employment (Articles 16-10, Article 49-6, and Article 50)

E. Newly insert grounds for reducing industrial accident insurance premiums for persons in special types of employment, prescribed by Presidential Decree, subject to the Industrial Accident Compensation Insurance Act (Article 49-3, paragraph 5, newly inserted)
