(1) Reasons for Proposal
This proposal aims to improve and supplement certain shortcomings that have surfaced in the operation of the current system by expanding the scope of areas subject to designation as district unit planning zones under district unit planning for mixed-use development of areas in spheres of influence of major stations, permitting agricultural machinery maintenance shop sites and otherwise improving site regulations, preventing urban sprawl in planned management areas by encouraging growth management plans, providing a legal basis for minor changes that allow deliberation, etc. by the urban planning committee to be omitted when changing minimum site regulated area plans to streamline procedures, newly inserting a procedure for providing a notice in writing in the case of an order for reinstatement regarding illegal development, clarifying the criteria regarding distancing between residential areas and lodging facilities, etc.
(2) Major Provisions
A. Minor Changes to Minimum Site Regulated Area Plans (Article 25)
Provide a legal basis for minor changes that allow deliberation, etc. by the urban planning committee to be omitted.
B. Areas Subject to Designation as District Unit Planning Zones Under District Unit Planning for Mixed-Use Development of Areas in Sphere of Influence of Major Stations (Article 43)
Include general residential areas in areas subject to designation as district unit planning zones under district unit planning for mixed-use development of areas in the sphere of influence of major stations.
C. Procedure for Notice in Writing in the Case of an Order for Reinstatement Regarding Illegal Development (Article 59)
Supplement the procedure regarding notices provided by administrative agencies in the case of an order for reinstatement regarding illegal development by prescribing that reinstatement measures and deadlines shall be clearly stated in notices provided in writing.
D. Clarification of Criteria Regarding Distancing Between Residential Areas and Lodging Facilities (attached Table 7-11)
Clarify that cases are when construction is conducted away from residential areas at a distance determined under ordinance based on each part of the relevant buildings.
E. Prevention of Urban Sprawl in Planned Management Areas with Growth Management Plans (attached Table 20)
1) Permit siting of factories or manufacturing shops in planned management areas only if the local government has established growth management plans in advance.
2) Prescribe that the effective date shall be 3 years from the date of amendment to the Enforcement Decree for metropolitan zones, large cities (population of 500 thousand or more) and adjacent Si/Gun, and for other areas, either 5 or 7 years from the date of amendment to the Enforcement Decree depending on the density, rate of increase, etc. of factories according to area.
