(1) Reasons for Proposal
The Amendment aims to provide specific provisions that allow basic rest areas to be installed in libraries, which are local public facilities, so as to ease inconvenience caused by site regulations of development restriction zones and vitalize local economies, to allow power supply facilities for motor vehicles and hydrogen fuel supply facilities as ancillary facilities so as to expand the charging infrastructure for eco-friendly vehicles, and to expand the installation qualification for flower exhibition and sales facilities, gas stations, etc.
In addition, the Amendment aims to improve and supplement some shortcomings found in the operation of the current system by means such as allowing the postponement of the collection of non-performance penalties where an urban or Gun management plan concerning the release of designation of development restriction zones has been formulated due to the implementation of public works projects, and allowing buildings that have already paid the charges for the preservation of development restriction zones to be exempt from being required to pay the charges when calculating the said charges.
(2) Major Provisions
A. Maintenance of the Calculation Standards of the Charges for Preservation of Development Restriction Zones (Article 36 (1) 1)
Allow the floor area of a building that has already paid the charges to be exempt from being required to pay the charges when calculating the charges for preservation of development restriction zones
B. Postponement of the Collection of Non-Performance Penalties in Regions that are Expected to be Released from being Designated as the Development Restriction Zones due to the Implementation of Public Works Projects (Article 41-2 (2))
Allow the postponement of the collection of non-performance penalties where an urban or Gun management plan concerning the release of designation of development restriction zones has been formulated due to the implementation of public works projects.
C. Amendment to the scope of types, construction, or installation of buildings or structures (attached Table 1 (3) items e, t, and w, (5) item e 4) and 10))
Allow basic rest areas in libraries within the development restriction zones as ancillary facilities, allow hydrogen fuel supply facilities and power supply facilities for motor vehicle to be installed as ancillary facilities, expand the scope of those who are eligible to install flower exhibition and sales facilities to cover agricultural cooperatives and farming association corporations, and expand the subjects eligible to install service stations, gas stations, and liquefied petroleum gas charging stations for motor vehicles to cover those who have resided in the restriction zones for 10 years or longer.
