(1) Reasons for Proposal
It is needed to respond to international regulations along with the standardization of e-Navigation by the International Maritime Organization (IMO) and react strategically in terms of promoting shipping, shipbuilding, and new industries. In this regard, this Enforcement Rule aims to define matters delegated by the Act on the Provision and Use of Intelligent Maritime Traffic Information Services (Act No. 16901; promulgated on January 29, 2020), which was recently legislated, such as maritime traffic information provision procedures, terminal installation exemptions, terminal registration, change, and termination, and other matters required to implement the Act.
(2) Major Provisions
A. Define maritime traffic information provision procedures (Article 2)
Require any person who wants to be provided with maritime traffic information to submit a maritime traffic information use application form and the Minister of Oceans and Fisheries to inform the applicant of the outcome of its review of maritime traffic information provision within 14 days, impose fees considering review costs required to process and provide maritime traffic information, and exempt such fees if maritime traffic information is used for nonprofit purposes.
B. Define terminal installation exemption and registration procedures (Article 3)
Define ships exempted from terminal installation as ships without propulsion engines or masts, ships operated only in inland waters such as lakes or rivers, steam ships and sailing ships of less than 20 gross tons under the Ship Act, fishing vessels of less than 2 gross tons under the Fishing Vessels Act, ships used for one-time sailing with a temporary sailing (or navigation) inspection certificate, and commissioning ships and specify administrative procedures required for management such as the technological level and registration of the terminal.
C. Define a facility pass for other people’s land (Article 4)
Define a “facility pass’” and its form as evidence indicating authorized access to other people’s land to install, repair, and investigate intelligent maritime traffic information service equipment.
D. Re-review regulations (Article 5)
Require the Minister of Oceans and Fisheries to review the validity of any ship whose terminal installation is exempted every 3 years to align exempted ships with the technical development of the terminal in the real world.
E. Define applicable examples for terminal registration (Addendum Article 1)
Specify that the terminal installed in any ship by the Ministry of Oceans and Fisheries’ terminal dissemination project and already registered in the intelligent maritime traffic information system before the enforcement date of the Enforcement Rule to promote the use of intelligent maritime traffic information services is recognized to comply with this Enforcement Rule.
