(1) Reasons for Proposal

With the Environmental Testing and Inspection Act (promulgated on March 31, 2020; to be enforced on October 1, 2020) amended to designate the measuring agency contract management organization and strengthen the management of measuring agency business, this Partial Amendment aims to define matters delegated from the Act while improving and supplementing some shortcomings found in the operation of the current system, including the revision of some terminology.

(2) Major Provisions

A. Designate work sites subject to measuring agency contract management (Article 13-2 newly inserted) 

- Designate Air Quality Types 1 to 2 and Water Quality Types 1 to 2 work sites as the ones whose measuring agency business owner is required to submit contract-related documentation to the measuring agency contract management organization

B. Define designation and cancellation standards and designation procedures for the measuring agency contract management organization (Article 13-3 newly inserted)

- Specify organizations eligible for the measuring agency contract management organization*

* National Institute of Environmental Research, Korea Environment Corporation, and Environmental Preservation Association

- Define designation (attached Table 1) and cancellation standards (attached Table 1-2) for the measuring agency contract management organization

- Define designation procedures for the measuring agency contract management organization

- Measuring agency contract management organization’s operational rules including professional measuring agency education and training

C. Specify the period of qualification suspension for technical staff in the measuring agency business* (Article 13-4 newly inserted)

* Suspend national technical qualification for 1 year if any measurement is performed during the suspension period for measuring operation or business
