(1) Reasons for Proposal
As partial amendments to the Framework Act on the Management of Disasters and Safety have been promulgated (Act No. 17383, June 9, 2020), this amendment aims to determine the provisions mandated by the Act and improve or supplement some of the operational shortcomings of the current provisions.
(2) Major Provisions
A. Stipulate detailed organizational structure of the Central Disaster and Safety Countermeasure Headquarters (CDSCH) (Article 15)
1) Delete the workforce composition of the CDSCH and stipulate the provision simply by requiring compliance with the composition of the Central Radioactive Disaster Prevention and Response Headquarters in the case of a radioactive disaster.
2) Separate the situation such as the operation of the joint vice head system and the exercise of the Prime Minister's authority on the CDSCH, and provide the legal basis for the detailed composition of the CDSCH.
3) Stipulate that in the case of overseas disasters, a working group shall be organized with public officials belonging to the Ministry of Foreign Affairs, and in the case of radioactive disasters, with public officials belonging to the Nuclear Safety and Security Commission.
B. Organization and operation of countermeasure support headquarters (Article 22-1)
1) Consist of public officials belonging to the Ministry of the Interior and Safety, persons dispatched from related disaster management agencies, and private experts.
2) To support disaster situations, etc., establish and operate working groups for each function, such as a general operation group, field management support group, and collaboration support group.
3) A support team may be organized in cooperation with related organizations and dispatched to a disaster area to support disaster management activities, etc.
4) Other matters necessary for the organization and operation of the countermeasure support headquarters shall be determined by the Minister of the Interior and Safety.
C. Stipulate the timing of addition and subscription of facilities subject to disaster-related insurance (attached Table 3 related to Article 83-3 and Article 83-4)
1) Add a facility that conducts a rural bed and breakfast business under the Agricultural and Fishing Villages Improvement Act to facilities subject to disaster-related insurance or mutual aid (attached Table 3 related to Article 83-3).
2) Also stipulate the “time to subscribe to insurance, etc.” of the facilities that operate a rural bed and breakfast business, equivalent to the lodging business and the tourist accommodation business (Article 83-4).
D. Active administrative exemption standards and operating procedures, etc. (Articles 86-3 and 86-4)
1) Present active administrative exemption standards and exclusion criteria (Article 86-3).
2) Prescribe procedures for operating active administrative exemptions (Article 86-4).
