(1) Reasons for Proposal

Since more than half of the deaths caused by industrial accidents occur at small construction sites, there is a pressing need to devise measures for safety control at small construction sites. Therefore, this Amendment aims to formulate the standards for establishing the safety control plans for small-scale sites by imposing the duties of safety control on the construction contractors and registered home construction contractors prior to the commencement of small-scale construction work, according to the amendment to the Construction Technology Promotion Act (Act No. 17441, promulgated on June 9, 2020) for the prevention of safety-related accidents during construction work, to find grounds for including the cost of formulating the safety control plans for small sites by construction contractors and registered home construction contractors, and to add a plan to establish a guide for preventing collisions between equipment and workers at the construction site, a plan to install and operate closed-circuit televisions, at a construction site for a multi-unit dwelling with 16 stories or more, a plan to secure evacuation routes, and a plan to designate and operate an operator exclusively for remote-controlled tower cranes, thereby preventing construction accidents. 

(2) Major Provisions

A. Formulation of criteria for safety control plans, etc. for small sites (Article 58 (2), Article 60 (1), and attached Table 7-2)

1) The Ordinance of the Ministry of Land, Infrastructure and Transport has devised details on the criteria for establishing safety control plans for small sites commissioned by Presidential Decree.

2) Allow construction contractors and registered home construction contractors to appropriate the cost required to establish safety control plans for small sites and execute this cost as safety control expenses. 

B. Newly inserted inspection items for periodic safety inspections of construction machinery (Article 59 (1))

1) Prescribe the safety operation procedures and the adequacy of safety measures against falls and collapse, such as the installation, dismantling, and raising of inspection items for periodic safety inspections of construction machinery.

C. Amendment to the criteria for establishing safety control plans (attached Table 7)

1) Mandate the deployment of a dedicated guide at the site to prevent any collision or caught in/between injuries with machinery and equipment at the construction site and the installation of closed-circuit television to identify the safety control status of the entire construction site for multi-unit dwellings with 16 stories or more.

2) Mandate the establishment of an evacuation plan in case of fire accidents and the implementation of evacuation drills from the period during which insulation materials with high risk of fire are built. 3) Mandate the preparation of a plan for installing and operating tower cranes to prevent turning towards the outside of the construction site, and the designation of a dedicated operator for each unmanned tower crane for the safety of pedestrians around the construction site.
