1. Reason for proposal

The recent trend is that various types of public conflicts become serious in the process of establishing and executing public policies due to diversified and complicated societies, and the need for systematic management of conflicts is increasing.

Therefore, the aim is to improve the conflict-preventing and -solving capability of central administrative agencies by prescribing matters on the roles, duties, procedures, and public debate to prevent and solve public conflicts and to contribute to social integration by preventing and solving conflicts smoothly with the establishment of a systematic foundation for participative decision making to obtain agreements through communication, negotiations, and discussions.

 

2. Main content

A. Duties of central administrative agencies to prevent and solve conflicts (Article 4 of the draft)

The heads of central administrative agencies shall establish integrated policies to strengthen the capability to prevent and solve conflicts and shall seek various means and actively use them to solve conflicts.

B. Principles in preventing and solving conflicts (Articles 6 through 10 of the draft)

The heads of central administrative agencies shall try for voluntary solution, guarantee of credibility, guarantee of participation, benefit-comparative sentences, and information disclosure, etc. through communication and agreements to prevent and solve conflicts.

C. Analysis of influences of conflicts (Article 11 of the draft)

The heads of central administrative agencies may analyze the influences of conflicts in advance by expecting and analyzing the causes of conflicts and seeking for measures if excessive social expenses are deemed likely to be incurred due to conflicts of people’s interest when establishing, executing, and amending public policies.

D. Establishment and operation of Conflict management and deliberation committee (Articles 12 through 14 of the draft)

The heads of central administrative agencies shall establish and operate a Conflict management and deliberation committee consisting of 11 to 15 members to deliberate on matters on the management of conflicts in the work concerned.

E. Utilization of participative decision-making method (Article 15 of the draft)

The heads of central administrative agencies may utilize a participative decision-making method with the participation of interested parties, general citizens, professionals, etc. if required for the establishment and execution of public policies and shall sufficiently consider the result of utilization of participative decision-making method when determining public policies.

F. Configuration and operation of Conflict adjustment committee (Articles 16 through 21 of the draft)

  The heads of central administrative agencies may configure and operate the Conflict adjustment committee for each issue consisting of related central administrative agencies and interested parties to solve conflicts caused by public policies.

G. Installation and operation of Public debate selection committee (Articles 24 through 32 of the draft)

A Public debate selection committee may be established under the Prime Minister to deliberate on whether to subject specific public conflicts to public debate in order to operate the public debate system fairly and systematically.

H. Installation and operation of Public debate committee (Articles 35 through 44 of the draft)

A public debate committee shall be temporarily established for the issue decided by the public debate selection committee for the fair and efficient operation of public debate, and matters on the operation of public debate for each issue shall be deliberated on and decided.

I. Designation and operation of conflict management support center (Article 45 and Article 46 of the draft)

The Chief of the Office of Government Policy Coordination may designate and operate a conflict management support center to perform investigation and research, etc. to prevent and solve conflicts.

J. Checking and reporting conflict management situations (Article 48 of the draft)

The Chief of the Office of Government Policy Coordination shall check and evaluate the conflict management situations of central administrative agencies.

K. Informatization system (Article 37 of the draft)

The Chief of the Office of Government Policy Coordination may establish a conflict management and informatization system for the efficient management of conflicts so that each agency and group may use such system.
