(1) Reasons for Proposal
With the revision of the “Guarantee of Automobile Accident Compensation Act (Act No. 17236, partially amended on April 7, 2020, to be enforced on October 8, 2020) to establish an insurance system for self-driving vehicles, the proposal aims to establish a notice that prescribes matters necessary for the operation of the Accident Investigation Committee for self-driving vehicles, accident investigation, etc.
(2) Major Provisions
A. Matters concerning the composition and operation of the Accident Investigation Committee (Articles 3 - 8)
- Prescribe matters such as commissioning members for each field (technology, road, public, private), term of office, etc., duties of the chairperson, matters to be deliberated and determined by the committee, and methods on deliberating agendas (face-to-face in principles or written methods for exceptions).
B. Matters concerning the composition and operation of the secretariat (Articles 9 - 11)
- Install the secretariat at the Korea Automobile Testing & Research Institute of the Korea Transportation Safety Authority, provide support related to the operation of the committee and meetings, and conduct accident investigations, etc.
C. Matters concerning the scope, procedures, etc., of accident investigations (Articles 12-23)
- Prescribe matters such as scope, purpose, method, and procedure of an accident investigation (payment of expenses vehicles, etc., provided for investigation).
- Content to be recorded on the recording unit of the self-driving information
D. Matters concerning the provision of information by the Accident Investigation Committee (Articles 24-25)
- Access and provision of investigation at the request of stakeholders (collection of fees under the Official Information Disclosure Act)
- Provide information at the request of the investigative agency or court.
E. Other matters (Articles 26-31)
- Prohibit any disclosure of privacy-related information and private use of committee information.
- Reasons for disqualification of employees of the secretariat and grounds for the payment of member allowances, etc.
