(1) Reasons for Proposal

The Amendment aims to expand the applicable scope of the compounding manager certificate and allow the compounding managers to enter various fields in the cosmetics industry by recognizing those who have passed the qualification exam for custom cosmetic compounding managers, which was introduced in accordance with the amendment to the “Cosmetics Act” (Act No. 15488, enforced on March 14, 2020),  

to mandate responsible distribution managers and custom cosmetic compounding managers to receive training required under Article 5 (5) of the Act within 6 months from the date of their appointment to ensure that they acquire the capabilities required to perform as quality control managers in the early stages, and supplement and improve the matters on completing training to be reasonable by means such as exempting the training for the initial appointment on the year in which they pass the qualification exam for compounding managers,  

and to clarify the legal grounds for matters on the designation of training institutions and training operations set forth under the current public notification, and prescribe the duty to obtain and store supporting evidence for natural cosmetics or organic cosmetics under the Ordinance of the Prime Minister, thereby clarifying the legal grounds for the rights and duties of the people. 

(2) Major Provisions

A. Expansion of the qualification standards for responsible distribution managers (Article 8)

Recognize a person who has passed the qualification exam for custom cosmetics compounding managers and worked in the cosmetics manufacturing or quality control work for at least one year to satisfy the qualification standards for responsible distribution managers. 

B. Modification to the detailed standards for operation of training for responsible distribution managers, etc. (Article 14)

1) Mandate responsible distribution managers and custom cosmetics compounding managers to receive the training under Article 5 (5) within 6 months from the date of their appointment and exempt those who are appointed as custom cosmetics compounding managers from receiving their initial training on the year in which they obtain the said qualification.

2) Specify the scope of delegation to allow the Minister of Food and Drug Safety to determine the detailed matters on the designation of training institutions and operations of training. 

C. Acquisition of supporting evidence for natural or organic cosmetics (Article 23)

Where a person intends to indicate or advertise cosmetics as natural or organic cosmetics, require him/her to acquire and preserve supporting evidence for such claim. 

D. Others (Forms 6 and 6-5)

1) Modify the period for registration of modification to the responsible cosmetics distribution business from 15 days to 10 days.

2) Delete the field for the name in Chinese characters in the application form for qualification of custom cosmetics compounding managers.
