(1) Reasons for Proposal

With the amendment of the Road Traffic Act (Act No. 17371; promulgated on June 9, 2020; to be enforced on December 10, 2020) to define personal mobility devices, set forth driving requirements, and punish super-speeding drivers, this Partial Amendment aims to define matters delegated from the Act, including creating standards for personal mobility devices and defining administrative disposition criteria for super-speeding drivers, and other matters required for its enforcement, while correcting omissions of expressions and entries in a traffic accident fact confirmation form, which led to disputes between involved parties. 

(2) Major Provisions

A. Define standards and the number of passengers for personal mobility devices as delegated in law by Ordinance of the Ministry of the Interior and Safety (Articles 2-2 and 33).

B. Exclude personal mobility devices from driver’s license requirements since the obligation to acquire a driver’s license is excluded for personal mobility devices (Article 54).

C. Strengthen administrative disposition criteria for super-speeding drivers since punishment for such drivers has been tightened (attached Table 28).

D. Change the applicant in a traffic accident fact confirmation form from the perpetrator/victim to the party and delete perpetrator and victim entries in the form (Article 129-3 paragraph 1, attached Forms 144-6 and 144-7).
