(1) Reasons for Proposal
The Amendment aims to specify details of the employer's duties and fire risk monitoring activities for prevention of explosions or fires, and prohibit the use of heating apparatus at the same time in places where hazardous materials are handled, expand those who are qualified to measure oxygen and harmful gas concentrations in enclosed spaces, and include telemetry in the measurement method to strengthen the prevention of explosions or fire accidents and improve and supplement some shortcomings found in the operation of the current system.
(2) Major Provisions
A. Specify employer's duties in the prevention of explosions and fires (Article 232)
1) The details of explosion and fire prevention measures against steam, gas, or dust of the current employer are stipulated in an inclusive manner, and thus it is necessary to specify the details.
2) Secure the safety of workers by specifying examples of ventilation systems for ventilation and dust removal measures.
B. Specify the monitoring work for a fire lookout (Article 241-2)
1) As the monitoring details of a fire lookout who is allocated at places where employer does welding are not prescribed, it is necessary to clarify such details.
2) Strengthen fire prevention functions by clearly stipulating the details of fire risk monitoring activities such as checking hazardous materials and checking whether the fire prevention facilities are operational.
C. Prohibit any simultaneous use of heating apparatus in places where hazardous materials are handled (Article 242)
1) Even though heating apparatus should not be used in a place with fire and explosion hazards, work using heating apparatus are carried out at the same time as handling hazardous materials, and thus accidents are likely to occur.
2) Clearly stipulate that hazardous materials, such as flammable materials, must not be handled at the same time work is being performed using heating apparatus.
D. Expand the qualification requirements to measure the concentration of oxygen and harmful gas and include telemetry using wireless facilities and wireless telecommunications in the measurement method (Article 619-2)
1) Because the qualifications for measuring oxygen and harmful gas concentrations to prevent choking accidents in enclosed spaces are limited, it is difficult to measure oxygen concentration in small business establishments, etc.
2) Add those who have completed the education of the Korea Occupational Safety and Health Agency and construction accident prevention guidance agencies in the scope of parties qualified to measure oxygen and harmful gas concentration to facilitate oxygen measurement at business establishments.
3) Prescribe to include telemetry using wireless facilities and wireless telecommunications in the oxygen concentration measurement methods.
