(1) Reasons for Proposal
This Enforcement Decree aims to separate matters for the safety management of electric installations from the Electric Utility Act to ensure independence in the safety management system from the electric utility sector, and define matters delegated from and other matters required to enforce the Electrical Safety Management Act (Act No. 17171; promulgated on March 31, 2020; to be enforced on April 1, 2021) legislated to prevent any disaster arising from an electrical safety accident, promote public safety, and systematically manage safety across the installation and maintenance of electric installations.
(2) Major Provisions
A. Define the scope of minor changes and requests to submit documentation or cooperation in establishing the Electrical Safety Management Master Plan (Articles 2 and 3).
B. Specify the composition, function and operation of the Electrical Safety Advisory Organization (Articles 4 through 6).
C. Define criteria to approve works to establish electric installations for private use (Article 7).
D. Specify pre-use inspection and electrical safety inspection of facilities used by the public, which operators of the electric sales business are required to conduct (Articles 8 and 9).
E. Define the eligibility and scope of emergency measures at night or in case of emergency (Article 10).
F. Specify compensation procedures for losses in case of safety measures in place to prevent electrical accidents (Article 11).
G. Define the disclosure, method, and scope of information such as electrical facility test and inspection results (Articles 12 and 13).
H. Specify the registration requirements and procedures of persons specializing in electrical safety management duties (Article 14).
I. Define the time and applicability of fact-finding investigation on electrical safety management duties (Article 15).
J. Specify matters regarding funding sources for operation of the Korea Electrical Safety Corporation including accident prevention inspection costs (Article 16).
K. Define the function and task of the Comprehensive Electrical Safety Information System (Article 17).
L. Specify those entities subject to investigation for the cause or progress of an electrical accident, and the preparation and management of electrical accident statistics (Articles 18 and 19).
M. Define matters delegated/entrusted from the Minister of Trade, Industry and Energy and Mayor/Do Governor (Article 20).
N. Specify the handling and method of personally identifiable information and criteria to impose penalty surcharges (Articles 21 and 22).
