(1) Reasons for Proposal
As the Mechanical Equipment Act was enacted (Act No. 15598, promulgated on April 17, 2018, and enforced on April 18, 2020) to develop the mechanical equipment industry and ensure the efficient maintenance and performance of mechanical equipment, this Standards aims to determine the details of the technical standards necessary to secure the safety and performance of mechanical equipment and the necessary matters entrusted by this Act and the Ordinance of the Ministry of Land, Infrastructure and Transport, such as determining detailed procedures and related forms necessary for preconstruction verification and pre-use inspection on mechanical equipment, and matters necessary for their implementation.
(2) Major Provisions
A. Stipulate general principles of design and construction of mechanical equipment (Articles 6 and 7)
Stipulate general standards applicable to the design of mechanical equipment, standards for energy conservation, and general standards applicable to the construction of mechanical equipment.
B. Stipulated design and construction standards for mechanical equipment installed in buildings, etc. (Article 8)
Stipulate design and construction standards for each category of mechanical equipment installed in buildings and facilities, and detailed standards for improving the safety and performance of mechanical equipment.
C. Stipulate design standards, considering mechanical equipment maintenance, etc. (Article 9)
Stipulate design standards for convenience of maintenance after the construction of mechanical equipment.
D. Stipulate the obligation to pay proper consideration for the design of mechanical equipment (Article 10)
Stipulate the obligation on those who place an order for mechanical equipment work to pay proper consideration for the design of mechanical equipment and to comply with the subcontracting law.
E. Stipulate detailed standards for the construction procedure of mechanical equipment work (Articles 11, 12 and 13)
Stipulate that mechanical equipment constructors shall prepare construction plans, detailed construction drawings, and progress schedules before the commencement of the construction of mechanical equipment work and then obtain approval from the person performing supervisory work.
F. Stipulate detailed procedures for safety management at the site of mechanical equipment work (Article 14)
Specify the obligation to comply with standards for securing construction site safety and preventing industrial accidents and stipulate that funds for occupational safety and health management shall be included in the construction costs.
G. Stipulate preparing procedures for mechanical equipment maintenance instructions (Article 15)
Stipulate that mechanical equipment constructors shall prepare and review maintenance instructions in accordance with the maintenance standards after completion of construction and submit them to project owners, etc.
H. Stipulate construction standards for other mechanical equipment work such as temporary construction (Article 16)
Provide detailed standards for securing safety at the site of temporary construction of mechanical equipment and stipulate that other work such as plastering and waterproofing shall comply with standard specifications.
I. Stipulate the details of the confirmation procedures before starting the mechanical equipment construction (Articles 17 and 18)
Provide specific standards for classifying buildings subject to confirmation before construction begins and stipulate detailed procedures for local governments' licensing and approval.
J. Provide performance check procedures after the construction of mechanical equipment work (Article 19)
Stipulate that the mechanical equipment constructor shall implement performance and safety evaluation after completing the mechanical equipment work, and the person performing supervisory work shall prepare a confirmation of suitability for use and submit it to the person placing an order.
J. Stipulate detailed procedures for pre-use inspection of mechanical equipment (Article 20)
Stipulate detailed procedures for licensing and approval related to pre-use inspection by local governments.
K. Preparation of business manuals for preconstruction verification and pre-use inspection (Article 21)
Stipulate that business manuals will be prepared and distributed for local government licensing personnel and persons placing orders who apply for pre-construction verification and pre-use inspection.
M. Stipulate detailed procedures for the management of technical standards (Article 22)
Stipulate that opinions will be collected from related organizations and request the work of relevant agencies for efficient revision when the technical standards are revised.
N. Special cases concerning new technologies and new construction methods (Article 23)
Stipulate a partial exemption from the obligation to comply with standards for mechanical equipment work that requires the use of design and construction standards that are not included in the technical standards due to technological advances, etc.
