(1) Reasons for Proposal
These Guidelines aim to determine matters entrusted by the Enforcement Rule and matters necessary for its enforcement since the Act on the Development and Management of Logistics Facilities has been revised with the main content of the introduction of the smart logistics center certification system (Act No. 17232, promulgated on April 7, 2020, and enforced on October 8, 2020), and since the Enforcement Rule of the same Act has been revised (promulgated and enforced on December 23, 2020).
(2) Major Provisions
A. Detailed standards for smart logistics center certification (Article 2)
Stipulate the evaluation items, evaluation formulas, and score standards for each grade of the certification grade to define the details of the certification standards for smart logistics centers (Article 13-2 of the Rule) and allow adjustments to the weight of evaluation item scores in functional areas in consideration of the individual characteristics of smart logistics centers subject to evaluation.
B. Application and procedures for re-examination (Article 4)
Stipulate re-examination procedures, such as documents to be submitted and the agenda setting of the Certification Deliberation Committee within 60 days when an applicant for the certification of the smart logistics center has an objection to the result of the certification examination and applies for re-examination (Article 13-3 (6) of the Rule).
C. Composition of the Certification Deliberation Committee and the Certification Examination Team (Article 5 through Article 7)
To define the details of the organization and operation of the certification body (Article 13-7 of the Rule), such as the composition of the Certification Deliberation Committee and the Certification Examination Team, stipulate the method of operation of the Certification Deliberation Committee, standards for the composition of professional personnel of the Certification Examination Team, and matters concerning the exclusion, challenge, or evasion of certification deliberation members, etc.
D. Inspection of certified logistics centers, etc. (Article 8)
To define the details of regular and irregular inspections (Article 13-8 of the Rule) for smart logistics centers, stipulate the establishment of an inspection plan and the timing of notification to centers subject to the inspection, a request for corrective measures according to the inspection result, and request for cancellation of certification to the Minister of Land, Infrastructure and Transport.
E. Application for reinsurance of certificates, etc. (Article 9)
Stipulate matters concerning the procedure for reinsurance application when a certificate has been damaged or changed in the stated matters after issuance of the certificate (Article 13-3 of the Rule).
