If there is a concern that the labeling or advertising of food, etc., may be unreasonable, the Minister of Food and Drug Safety is allowed to request the submission of empirical data to disclose the specific details thereof, and order the suspension of the labeling and advertising if the ordered party continues the labeling and advertising without submitting the empirical data. In addition, as the Act on Labeling and Advertising of Foods has been amended (Act No. 17808, Dec. 29, 2020) to allow the minister to issue administrative sanctions such as business suspension for continued labeling and advertising even after the issuance of an order to stop labeling or advertising, the Amendment aims to set the individual standards for the administrative dispositions for violations. Furthermore, while it is necessary to label cautionary statements for handling food additives such as ammonium hydroxide, including “Do not ingest or drink,” the Amendment aims to require the labeling of cautionary statements for sodium nitrite, a food additive so as to reinforce consumer protection for the products, and to reorganize and regulate special purpose foods that are currently subject to self-review for labeling and advertising as special nutritional foods and special medical foods pursuant to the food standards and specifications under the Food Sanitation Act.
