(1) Reasons for Proposal
The Industrial Sites and Development Act was amended to introduce the concept of a Smart Green Industrial Cluster and lay the foundation to promote the cluster (Act No. 17741; promulgated on December 22, 2020; to be enforced on June 23, 2021), and this Act aims to define matters delegated from the Act and other matters required for the implementation thereof such as buildings in the Smart Green Industrial Cluster subject to green building certification and projects that can request required support to promote the establishment of the Smart Green Industrial Cluster, define the scope of industrial facilities to support new industries, and clarify the basis to subsidize project implementors.
(2) Major Provisions
A. Include aquafarming that applies the latest technology to facilities occupying the industrial facility land (Article 1-2 subparagraph 4)
Allow primary industries to occupy the industrial facility land to some extent to enhance industrial competitiveness and promote private investment since primary industries such as agriculture and fishery cannot currently occupy the land, although there have been some attempts to develop an industrial cluster to promote aquafarming that applies the latest technology.
B. Define applicable buildings in the Smart Green Industrial Cluster subject to green building certification (Article 9-2)
Define applicable buildings in the Smart Green Industrial Cluster subject to green building certification under Article 16, paragraph 7 of the Green Building Construction Support Act and energy efficiency grade certification under Article 17, paragraph 6 thereof.
C. Define a special case for the designation of the Smart Green Industrial Cluster (Article 9-3)
Define projects where the Minister of Land, Infrastructure and Transport can request required support from the head of the competent administrative agency at the request of the City Mayor/Do Governor to promote the establishment of the Smart Green Industrial Cluster.
D. Clarify the basis to subsidize project implementation expenses (Article 26 subparagraph 6)
Clarify subsidies for expenses to purchase land to build a Knowledge Industry Center.
E. Prepare the basis to decrease the parcel price to establish the Smart Green Industrial Cluster (Article 40 paragraph 4 subparagraph 3)
Prepare the basis that provides the Smart Green Industrial Cluster to those who want to build the cluster by obtaining green building certification under the Green Building Construction Support Act below the actual price for its establishment.
F. Define how to supply development land to establish the Smart Green Industrial Cluster (Article 42-3, paragraph 3 subparagraph 11)
Prepare the basis that prioritizes those who want to build the cluster by obtaining green building certification under the Green Building Construction Support Act and supplies the industrial facility land to them first.
