(1) Reasons for Proposal
The Clean Air Conservation Act (Act No. 17797; promulgated on December 29, 2020; enforced on June 30, 2021 (partially to be enforced on December 30, 2021)) was amended to require the testing agency for motor vehicle exhaust certification to report to the Minister of Environment any material change set forth by Ordinance of the Ministry of Environment and specify the local government to which a fugitive dust-emitting business located in more than one local governments must report, and this Partial Amendment aims to define matters delegated by the Act regarding reporting of changes by the testing agency for motor vehicle exhaust certification.
It also improves and supplements some shortcomings observed in the operation of the current system, including the regular motorcycle inspection order form.
(2) Major Provisions
A. Allow the measurement agency to report results on behalf of a business entity (Article 52, paragraph 4)
Allow the measurement agency to report a business entity’s measurement results on behalf of the business entity.
B. Update the sharing of report details from fugitive dust-emitting businesses located in more than one local governments (Article 58, paragraphs 2 and 3)
Update the report sharing procedure, which is only defined for construction located in more than one local governments, to apply to fugitive dust-emitting business located in more than one local governments with an amendment to Article 43, paragraph 2 of the Act.
C. Improve the deadline for reporting any change in volatile organic compound-emitting facilities (Article 60, paragraph 2)
Change the deadline for reporting any change for completely shutting down fueling and storage facilities in gas stations to within 30 days in line with the Soil Environment Conservation Act.
D. Rationalize the defect correction plan procedure regarding motor vehicle exhaust (Article 75)
Improve the unreasonable deadline that requires the submission of a defect correction plan within 45 days by extending it up to 30 days should any unavoidable reason arise.
E. Specify the motor vehicle owner’s maintenance obligations (Article 82-3)
Specify related matters by requiring the owner of a motor vehicle with exhaust emission reduction devices to check the devices and inject a cleaner or catalyst if necessary.
F. Prepare a specific requirement to report any change by the motor vehicle additive or catalyst manufacturer (Article 120-4)
Require the additive or catalyst manufacturer to report any change in the company name, representative, or address to the president of the National Institute of Environmental Research within 30 days.
G. Prepare a specific requirement to report any change by the motor vehicle additive or catalyst testing agency (Article 121-3)
Require the additive or catalyst testing agency to report any change from its designation in technical staff and equipment to the president of the National Institute of Environmental Research within 30 days.
