(1) Reasons for Proposal

Since the Environmental Health Act has been revised (Act No. 17007, promulgated on January 5, 2021, and to be enforced on July 6, 2021) to require local governments to prepare a “regional environmental health plan” to reinforce the responsibilities and role of local governments in environmental health and establish a “regional health impact investigation group” under local governments, this amendment aims to determine the matters delegated to the Presidential Decree by the Act and matters necessary for its implementation; 

strengthen the management standards for some environmentally hazardous factors (lead and phthalates) that were lower than those of advanced foreign countries (U.S., EU, etc.) in the environmental safety management standards for children's activity spaces or were excluded from management to protect children's health from environmentally hazardous factors; and rationalize indoor air quality management regulations to alleviate the burden of inspection by child care center owners due to overlapping indoor air quality management (limited to child care centers under the Indoor Air Quality Control Act).

(2) Major Provisions

A. Establish detailed provisions for establishing regional environmental health plans (every 10 years) for regional local governments (Article 2-2). 

B. Establish detailed provisions for the composition and operation of the regional environmental health committee (within 20 people) (Article 10-2). 

C. Establish detailed provisions for the composition and operation of a regional health impact investigation group (within 15 people) (Article13-2). 

D. Establish a legal fiction for compliance with indoor air quality management standards (Article 16-4). 

E. Strengthen lead and phthalates management standards in children's activity spaces (attached Table 2).
