(1) Reasons for Proposal
As the integrated permit agency registration system was introduced (Act No. 17856; promulgated on January 5, 2021; enforced on July 1, 2021), which defines appropriate technical and personnel requirements and other matters the integrated permit agency must comply with, this Amendment aims to specify matters delegated by Presidential Decree and other matters required for the enforcement thereof.
Furthermore, it also aims to define matters required for the enforcement thereof, which includes calculation criteria delegated by Presidential Decree to impose penalty surcharges replacing the disposition of use suspension for an existing business entity that has not obtained an integrated permit within the grace period.
(2) Major Provisions
A. Prepare criteria for technical personnel, facilities, and equipment in integrated permit agency business (Article 4-2 paragraph 1 and attached Table 4-2)
(Personnel criteria) ① At least 1 advanced person, ② At least 4 general persons
* ① Engineer, PhD; ② Technician, Master’s degree
(Facility and equipment criteria) Separate office, and documentation program to prepare an integrated environmental control plan
B. Define integrated permit agency business subject to change registration (Article 4-2 paragraph 2)
Require registration for any change in integrated permit agency business’s trade name, name, representative, technical personnel status, and office location.
C. Define the amount of penalty surcharges replacing the disposition of use suspension for an existing business entity that has not obtained an integrated permit within the grace period (Article 23-2 and attached Table 13-2)
Multiply 1/ 3,600 of the business entity’s annual revenue by the number of days with use suspension, and multiply the imposition factor according to the progress of the business entity’s integrated permit (attached Table 13-2).
D. Prepare the basis for integrated permit system work to manage the registration system (Article 33 paragraph 1 subparagraphs 4-2 through 4-7)
Allow for electronically managing integrated permit agency business registration and change registration, integrated permit documentation entry and retention, integrated permit agency business temporary/permanent closure reporting, registration cancellation, business suspension, sales performance evaluation and disclosure, and agency performance reporting.
E. Prepare criteria to impose penalty surcharges for integrated permit agency business (attached Table 14)
Specify the criteria for imposing penalty surcharges by legal violation, including the agency’s improper integrated permit documentation.
