(1) Reasons for Proposal
The Clean Air Conservation Act (Act No. 00000; promulgated on 00. 00., 2021; enforced on 00. 00., 2021) was amended to include approval for hydrogen fuel supply facility installation plans, and this Act aims to define matters delegated by the Act and other matters required for the enforcement thereof such as requirements included in hydrogen fuel supply facility installation plans, conditions required for approval of changes in installation plans, and installation plan approval and certification delegated to the head of an environmental office.
(2) Major Provisions
A. Require any person who wants to install hydrogen fuel supply facilities to submit installation plans to the Minister of Environment for approval before obtaining certification, define documents to submit for installation plans, included information, changes requiring approval, and competent authorities, and allow the Minister of Environment to review the submitted documentation, check on site, and listen to feedback from experts when approving installation plans (Article 52-5 newly inserted).
B. Delegate the authority to approve and certify hydrogen fuel supply facility installation plans to the head of a local/regional environmental office and the head of the Metropolitan Air Quality Management Office (Article 63, paragraph 2).
C. Commission the Korea Environment Corporation to review of hydrogen fuel supply facility installation plans and documents and delegate the installation and operation of an electronic network for low-emission motor vehicle fuel supply facilities to the Korea Environment Corporation and Korea Automobile Environmental Association (Article 66, paragraphs 1 and 3).
D. Add approval of hydrogen fuel supply facility installation plans for review of regulations (Article 66-2, subparagraph 9 newly inserted).
E. Process uniquely identifiable information such as resident registration numbers when approving hydrogen fuel supply facility installation plans (Article 66-3, paragraph 6-4 newly inserted).
