(1) Reasons for Proposal
This Amendment aims to prepare the basis to provide visual dormitory materials so that enough information can be provided in advance in the event that employers provide a dormitory for foreign workers, update some items in Foreigner Dormitory Facility Table, which may be mistaken to meet dormitory facility standards, and thereby improve and supplement some shortcomings observed in operations so far.
(2) Major Provisions
A. Prepare the basis to submit visual dormitory materials (newly inserted)
¡ Provide Foreigner Dormitory Facility Table and visual materials (photos, videos, etc.) in the event that employers provide a dormitory for foreign workers.
- Provide visual materials about dormitory view, bedroom (including locks), bathroom, bath facilities (including locks), heating/cooling facilities, lighting and ventilation facilities, fire protection facilities, and storage areas.
B. Gradually expand the implementation timing of amended provisions
¡ Gradually expand the submission of visual materials so that foreign workers can be fully informed about information on residential facilities.
- Apply to agricultural, livestock, and fishery areas, where residential facilities are poor, first, and then other areas from July 1, 2021.
C. Amend Form 1 (Foreigner Dormitory Facility Table)
¡ Specify disadvantages (cancellation or restriction on employment permits) for any violation of the Labor Standards Act in cautions in the Foreigner Dormitory Facility Table so that employers can be informed clearly.
¡ Remove the Labor Standards Act from the title of employer requirements.
- Change the number of residential persons per room from ≤15 to ≤8.
¡ Change employers’ Resident Registration Number in business status to their date of birth to protect privacy.
¡ Submit documentation which proves temporary buildings (containers, assembly panels, etc.), workplace buildings, or other residential facilities have “a report certificate for temporary building construction” and are “residential facilities on the building register.”
¡ Specify Article 56 (Places to Build Dormitory) of the Enforcement Decree of the Labor Standards Act.
¡ Delete fan heaters and radiators from optional items so that heating products such as fan heaters and radiators without floor heating including boilers are not considered to meet facility standards.
¡ Recognize only closed windows with fans since they need ventilation facilities.
¡ Consider fire protection facilities to have been installed only when both fire extinguishers and smoke detectors are installed.
