(1) Reasons for Proposal

As the Special Act for the Construction of the Gadeokdo New Airport has been enacted (Act No. 17938; promulgated on March 16, 2021; to be enforced on September 17, 2021) to contribute to the balanced development of the national land and strengthen national competitiveness by defining matters necessary for the rapid construction of Gadeokdo New Airport, the Enforcement Decree and the Enforcement Rules of the Act are enacted to stipulate matters delegated by the Act and necessary for its enforcement.

(2) Major Provisions

<Enactment of the Enforcement Decree of the Special Act for the Construction of the Gadeokdo New Airport>

A. Changes in the basic plan for new airport construction (Article 3) 

Stipulate important changes requiring changes to the basic plan and detailed procedures for establishing and changing the basic plan.

B. Facilities that do not belong to the State (Article 4) 

Define airport facilities, such as facilities for maintenance of airports and amenities for airport users, installed in the airport zone and airport facilities installed outside the airport zone as facilities that do not belong to the state.

C. Approval of the implementation plan for the new airport construction project (Article 5) 

Stipulate that the implementer who has obtained permission to execute the new airport construction project shall establish an implementation plan for the new airport construction and apply for approval within three years from the date of obtaining the permission (if inevitable, it can be extended within one year).

D. Designation, etc., of a peripheral development-prearranged area (Article 6) 

Stipulate that all or part of the area, etc., requiring countermeasures against noise within the range of 10 km from the boundary of the new airport construction project area shall be designated as a peripheral development-prearranged area, and support or preferential measures can be established and implemented for projects such as urban development/maintenance/regeneration and regional development promoted in the relevant area.

E. Organization and operation of a steering group for new airport construction (Article 7) 

Stipulate that a steering group for new airport construction to smoothly promote the new airport construction project shall consist of a head and members, and necessary matters related to the organization and operation of the steering group shall comply with the Organization of the Ministry of Land, Infrastructure and Transport and Institutions attached thereto.

F. Financial support for the new airport construction project (Article 8) 

Stipulate that specific items, percentages of support, etc., that the State may subsidize or finance for the new airport construction project shall be determined in consultation with the Minister of Strategy and Finance.

G. Support for private capital attracting projects (Article 9) 

Stipulate that to support private developers, they may be granted licenses for peripheral land development projects such as a tourism complex development project, urban development project, and housing construction project or may perform inhabitant relocation measures and loss compensation work on behalf of the implementer.

H. Preferential treatment for local enterprises (Article 10) 

Stipulate that contract objects such as construction, goods, and services that can be favored to local enterprises shall be determined in relation to the new airport construction, and preferential criteria shall be determined in consultation with the Minister of Strategy and Finance in consideration of the nature, etc., of contracts.

I. Amounts, imposition, and collection methods for penalty surcharges (Articles 12, 13, and 14) 

Stipulate the type of violations to be imposed penalty surcharges in lieu of an order to suspend the validity of permits/approvals and construction for the violation of the Act, and the amount of the penalty surcharges and the imposition and collection method for the penalty surcharges depending on the degree, etc., of the violations.

<Enactment of the Enforcement Rules of the Special Act for the Construction of the Gadeokdo New Airport>

A. Permission to implement the new airport construction project (Article 2) 

Stipulate all documents, drawings, and related forms including project and funding plans that must be included in the application for permission for the implementation of the new airport construction project, and the execution permit to be issued to the applicant.

B. Establishment and approval of the implementation plan for the new airport construction project (Article 3) 

Stipulate all documents, drawings, and related forms including location maps, design drawings, compensation plans that must be included in the implementation plan for the new airport construction project, and the approval of the implementation plan/change approval to be issued to the applicant.

C. Identification of inspection officers (Article 4) 

Stipulate the identification form (affiliation, name, etc., to be printed) to be presented when accessing the workplaces of the project implementer to inspect the work related to the new airport construction project.

D. Standards for the disposition of violations (Article 5 and attached Table) 

Stipulate disposition standards for each violation, such as the cancellation of permission and an order to suspend construction (attached Table) when the project implementer violates relevant standards such as the implementation plan.
