Enactment of the Enforcement Decree of the Act on the Management and Promotion of Urban Industrial Area (Draft)
a. Definition of terms such as industrial areas, etc. prescribed by other statutes (Articles 2 through 4 of Draft)
Clearly prescribe the detailed contents and types with regard to industrial areas, supporting infrastructure, and public rental industrial facilities determined pursuant to other laws delegated by the Act
b. Contents of the basic policy for national industrial areas and procedure for establishment (Articles 5 through 8 of Draft)
The basic policy for national industrial areas shall prescribe and include the industrial redevelopment areas, rules for designation of industrial innovation area and basic direction of the plan, basic direction of establishment of supporting infrastructure and basic direction of financial assistance, etc. for the promotion of industrial areas and shall determine the items for the investigation of actual conditions and method and procedure thereof.
c. Classification such as management types of industrial areas, etc. (Article 9 of Draft)
Considering the characteristics of the industrial area concerned, break down into industrial innovation type, industrial redevelopment type, and industrial management type and classify the management types so that effective industrial area redevelopment can be undertaken, such as application in combination if necessary
d. Contents of the master plan for industrial area and procedure for formulation (Articles 10 through 14 of Draft)
The master plan for industrial area shall prescribe and include contents such as industrial innovation and plan for creating jobs, plan for relocation of factories located in an area other than an industrial area, etc., and prescribe the contents and procedure, etc. necessary for the formulation of the master plan for industrial area, such as basic investigation to formulate the master plan, hearing of opinion of residents and local assembly, minor change, etc.
e. Requirements for designation of industrial redevelopment area and procedure, etc. (Articles 15 through 24 of Draft)
Prescribe the requirements for designation of industrial redevelopment areas, such as degree of industrial decline and aging of buildings and infrastructure, etc., contents and procedures, etc. for the designation of redevelopment areas, such as methods of designation of division and combination, requirements for a proponent of designation of industrial redevelopment areas, contents of the industrial redevelopment area plan, etc.
f. Designation of industrial innovation area and procedure, etc. (Articles 25 through 27 of Draft)
Determine the requirements for designation of an industrial innovation area to be designated in order to promote innovation in an industrial area through complex land use and foster a regional base, including the contents and implementation procedure of the industrial innovation area plan proposed by the mayor/county governor and others, etc.
g. Qualification of project operator and attached documents for the application for designation (Articles 20 and 30 of Draft)
Prescribe the detailed requirements for a project operator of the industrial area redevelopment project and documents necessary for applying for designation as operator and procedure thereof, etc.
h. Candidates for general project manager, method of selection and responsibilities (Article 31 of Draft)
Prescribe the detailed requirements for the selection of the general project manager for the industrial area redevelopment project and responsibilities, etc.
i. Preparation and public notification of implementation plan, etc. (Articles 32 through 34 of Draft)
Prescribe the formulation of the implementation plan for the industrial area redevelopment project and contents of the public notification of approval of the implementation plan and determine the composition of a consultative body—and operation methods thereof—that can reconcile the difference of opinions of the relevant administrative agencies when the implementation plan is approved
j. Detailed contents by implementation method (Articles 35 and 36 of Draft)
Prescribe the project implementation procedure and standards according to the replotting project and management disposition methods
k. Detailed contents of the industrial area redevelopment project, such as public notification of completion of construction, etc. (Articles 37 through 46 of Draft)
Prescribe the detailed contents and procedure, etc. related to the implementation of the industrial area redevelopment project, such as public notification of completion of construction when implementing the industrial area redevelopment project, permission to use before completion of construction, scope of installation of supporting infrastructure, cost burden by local governments, and procedure, etc. of issuing bonds of the industrial area redevelopment project
l. Simplification of procedure for industrial area and special cases of regulations (Articles 47 through 51 of Draft)
Prescribe the composition of the Integrated Deliberation Committee for the simplification of procedure for the industrial area redevelopment project and documents necessary for exclusion, challenge, refrainment, and dismissal of a member thereof and integrated deliberation
m. Special cases of regulations on formulating the industrial redevelopment area plan and industrial innovation area plan (Articles 52 and 53 of Draft)
In formulating the industrial redevelopment area plan, the construction restrictions limited to those of buildings allowed within the industrial area are to be relaxed by municipal ordinances of the relevant city/gun, etc.; in formulating the site regulations’ minimum area plan, the housing function ratio is to be relaxed to ensure residential stability in formulating the industrial innovation area plan
n. Contents of support for industrial area redevelopment (Articles 54 through 61 of Draft)
Prescribe the detailed contents for support, etc., such as for the management and promotion of industrial area, support measures for companies occupying it, creation and operation of special accounts for industrial area redevelopment, business affairs of a dedicated organization and operation method thereof, designation of an industrial area management support organization, business affairs of a comprehensive innovation support center and establishment thereof
o. Entrustment and operation of comprehensive industrial area information network (Articles 66 through 68 of Draft)
Prescribe the entrustment and operation of the comprehensive industrial information network, delegation of authority, etc. for the prompt collection and analysis of information necessary for the management and promotion of industrial areas
