(1) Reasons for Proposal
As the Enforcement Rule of the Trucking Transport Business Act has been revised (Ordinance of the Ministry of Land, Infrastructure and Transport No. 738, promulgated on June 17, 2020), this amendment aims to supplement a number of weaknesses that have emerged from the operation of the system related to the replacement of retired trucks, such as establishing a cycle for the replacement of retired vehicles that increases the maximum load capacity, clarifying the scope of the replacement of retired vehicles for refrigerators or chiller trucks and courier trucks, and specifying affair processing procedures in a case where the deadline for reporting the replacement of a vehicle has elapsed.
(2) Major Provisions
A. Clarify the scope of the replacement of retired vehicles for refrigerators and chiller trucks (Article 3 (2)).
B. Clarify the scope of the replacement of retired vehicles for courier trucks (Article 6 (4) and Article 7 (3)).
C. Establish a cycle for the replacement of retired vehicles that increases the maximum load capacity in accordance with the revised Enforcement Rule of the Trucking Transport Business Act (Article 8).
D. Specify affair processing procedures in a case where the deadline for reporting the replacement of a vehicle has elapsed (Article 12).
E. Modify the system and wording, and provide a re-examination deadline (Articles 3 (1), Article 3 (2) 3, Article 6 (1) through (3), Article 10, Article 11, and Article 14).
