(1) Reasons for Proposal
As the Life Logistics Service Industry Development Act, which establishes the foundation to develop the life logistics service industry and promotes the rights of life logistics service employees and consumers, is to be enforced on July 27, 2021, this Enforcement Decree aims to specify matters outlined by the Act and prescribe the Presidential Decree so that the Act can be enforced on its enforcement date.
(2) Major Provisions
A. Register and change courier service business (Articles 2, 3, 4, 5, and 11)
Specify procedures and standards for courier service business registration (including change in registration) and cancellation to implement a courier service business registration system intended to efficiently manage a courier service business.
B. Manage stores (Article 6)
Allow courier service business owners to request documentation about the performance and planning of safety and health measures under the Occupational Safety and Health Act from stores to manage the safety of courier service employees in stores, and check whether applicable laws are violated based on documentation submitted from stores.
C. Define reasons to refuse the renewal of courier service transport consignment contracts (Articles 7 and 8)
Specify reasons for not renewing transport consignment contracts and exceptions from the termination of such contracts to facilitate the implementation of a courier service transport consignment contract renewal system.
D. Report the opening and closing of a courier service business (Articles 9 and 10)
Define procedures in reporting the opening and closing of a courier service business such as submitting reports, and determine methods to return motor vehicle registration certificates and motor vehicle registration license plates.
E. Introduce a small package courier service business owner certification system (Articles 12, 13, 14, and 15)
Specify and define certification recipients, standards, and procedures and legislate certification labeling methods to implement a certification system for persons providing safe and convenient life logistics service.
F. Define small package courier service business owner certification agencies (Articles 16, 17, and 18)
Define designation standards, procedures, and tasks for agencies, which can perform certification, to facilitate a small package courier service business owner certification system.
G. Define the Life Logistics Service Industry Development Master Plan (Article 20)
Define important requirements requiring a change in procedure in the Life Logistics Service Industry Development Master Plan to facilitate the establishment of such a change in the plan.
H. Define the Life Logistics Service Industry Policy Council (Articles 21 and 22)
Establish a policy council with the Vice Minister of Land, Infrastructure and Transport as its chair with high-ranking public officials from competent ministries and experts to consult important matters such as the Life Logistics Service Industry Development Master Plan and define other matters required for its operations.
I. Conduct fact-finding investigations and statistics (Articles 23 and 24)
Specify and define recipients and methods for life logistics service industry fact-finding investigations and determine the preparation and management of statistics based on fact-finding investigations to help in effectively establishing policies for the development of the life logistics service industry.
J. Support administration, financing, and startup (Articles 25 and 26)
Specify recipients eligible for administration and financing to develop the life logistics service industry and support related start-ups.
K. Nurture and manage professionals (Articles 27, 28, and 29)
Define matters to be included in policies to nurture and manage individuals with expertise in the life logistics service industry and other matters required to designate and cancel professional training institutes.
L. Conduct standardization and pilot projects (Articles 30 and 31)
Specify and define life logistics service subject to standardization to improve efficiency and determine details to implement pilot projects, including procedures, support methods, and performance evaluation.
M. Support the installation of life logistics facilities, etc. (Articles 32, 33, and 34)
Define projects prioritized by central or local governments for support to expand life logistics facilities, prepare logistics facility price standards and special cases for the percentage of paper in life logistics facilities, and specifically determine the projects that cause demand in life logistics service.
N. Define standard contracts and terms and conditions (Articles 35 and 36)
Prepare required information and procedures in standard contracts to ensure fair contracts, while defining reporting procedures and information included in the terms and conditions of life logistics service to better provide such service.
