1. Reason for proposal
As Article 23.9 of Clean Air Conservation Act is established for protection of surrounding environment and adequate control of emission facilities when installation of air pollutant emission facilities is permitted or the amendment is permitted (Promulgation on April 13, 2021 and enforcement on October 14, 2021), it is intended to specify the matters delegated under acts, to establish the standard on imposition of penalty surcharge when business closing of fugitive emission facilities or VOC emission facilities is substituted with penalty surcharge, and to improve and supplement some insufficient points found in operation of current system including improvement of the standard on registration of coolant collection business.
2. Main content
A. The standard on assignment of the condition for permission of air pollutant emission facilities is specified (Establishment of Article 11.7 of draft).
- Condition for permission is assigned in consideration of the matters needed to prevent environmental damages in adjacent areas including fugitive emission, bad odors, and noises and the matters needed to confirm satisfaction of pollutant emission quantity and permission allowance standard and optimum operation of preventive facilities when permitting installation (amendment) of air pollutant emission facilities.
B. The standard on imposition of penalty surcharge to fugitive emission facilities and VOC emission facilities is established (Establishment of Article 38.4 of draft).
- Imposition index is applied depending on the scales of business places and, in case of business places not classified in Appendix Table 1-3, minimum imposition index is applied.
C. The basis for delegation of education of coolant collection technicians is prepared and the standard on possession of storage facilities for coolant collection business is relieved (Establishment of Article 66 ix-5 and Article ix-6 of draft and establishment of Appendix Table 14-2 Remark 3).
- Legal basis is prepared for such work as notification of subjects of coolant collection technician education delegated to environmental complexes according to Regulation on education, etc. of coolant collection technicians and site check and evaluation, etc. when designating professional education institutions.
- Improvement is made to satisfy storage facility possession standard although storage facilities and transportation vehicles are borrowed for registration of coolant collection business.
